13.01.2022 COUNCILLOR CALL FOR BALLINA ONLY FOUR WHEEL DRIVERS TO BE ALLOWED ON LENNOX BEACH - by Halden Boyd BALLINA Shire Council is set to debate a Notice Of Motion cal...ling for 4WD permits to only be given to vehicles registered in the Ballina Shire, except for emergency services vehicles, to be allowed on Seven Mile Beach at Lennox Head. The Notice Of Motion from Councillor Jeff Johnson also calls that Council only offer 12 month permits. Councillor Johnson has also called for a report to be prepared that looks at permit costs and measures to ensure compliance, with a code of conduct including cancelling permits for vehicles who breach the code. Ballina Shire is one of the few areas along the coastline that allows vehicles to access its beaches. The beach access that runs from South Ballina down to the Richmond River Shire boundary at Broadwater is not controlled by Council as such, and so the motion is not related to that area. While the beaches are Crown Reserves they are managed by Ballina Shire, and Council and ratepayers pay for maintaining access tracks, administration of the permits and periodic monitoring. The latest move to restrict 4WD drive use on Ballina Shire beaches has surfaced after the issue came to a head back in April when hundreds of vehicles, mainly registered in Queensland, swarmed onto Seven Mile Beach with many people not adhering to social distancing under the first round of NSW COVID-19 Health Regulations. As well Seven Mile Beach at Lennox Head is becoming increasingly popular which has seen a rise in conflict between vehicles and other beach users, Councillor Johnson outlined in motion. Reducing the number of vehicles to Ballina Shire registered vehicles and removing the shorter term permits would not only reduce the number of vehicles on the beach, but it would also increase the level of self-monitoring amongst permit holders, Cr Johnson says in his Notice Of Motion. In order to purchase an annual permit a code of conduct needs to be agreed to and any proven breaches could result in a cancellation of the permit. A similar motion was submitted to its April 2020 Ordinary meeting where the Council resolved that as part of the review of the Plan of Management for Coastal Reserves that the Council examined ways to limit beach 4 wheel drive permits. It also resolved that Council also investigated moving the vehicle access point further to the north to where the current horse access is on Seven Mile Beach. The Coastal Reserve Plan of Management is due for review during 2020/21, and one difficulty with a system available to vehicles registered in the Ballina Shire is that the existing ticketing machine cannot confirm the registration location, a staff report accompanying the Notice Of Motion says. If permits are only available for 12 months, it may be more practical to offer permits from the Council Administration Centre, as this would then allow the applicant’s registration to be confirmed. These are operational matters that can be worked through if the recommendation is supported. There is some uncertainty as to whether the NSW Department of Planning, Industry and Environment (DPIE) Crown Lands, would allow a permit system for local residents only, as Crown Reserves are provided for the benefit of all NSW residents, not just residents of a local government area. Councillors should be managing crown land as NSW Crown Land Managers, not only as local government representatives. If the recommendation is supported, staff would follow up with DPIE to ensure the proposal can be implemented, the report says. The Council at the May 2020 Ordinary meeting undertook the four year review of the 4WD Beach Access Seven Mile Beach, Lennox Head Policy. This Council Policy established the framework that applies to 4WD users to manage the permitted 4WD beach access in a way that facilitates safe beach access and use, as well as minimising impacts on key environmental attributes of beach use.

04.01.2022 COMMERCIAL FISHING OPERATOR BUSTED WITH OVERSIZED FLATHEAD WHILE DANGLING A LINE OFF THE JOB NEW South Wales DPI fisheries officers conducting a vessel patrol o...n North Creek near Ballina have intercepted a man in possession of two oversize Dusky Flathead measuring 81cm and 80.5cm. The man, a 67 year old male from the NSW North Coast, is a licensed commercial operator in NSW, was recreationally fishing at the time. Fisheries officers were able to release the 80.5cm fish alive to the waters of North Creek at Ballina. Commercial operators can undertake recreational fishing in NSW but cannot sell their recreational catch. The man was issued a $500 penalty notice for possessing more than the possession limit, A NSW DPI Fisheries spokesman said. Dusky Flathead have a minimum size of 36cm and bag/possession of 10 only one of which can be longer than 70cm to protect larger female breeding stock. Dusky Flathead are one of NSW’s premier saltwater recreational species and larger breeding females enter NSW estuaries during spring months. Growing to weight of 15kg and a length of 1.5m Dusky Flathead are found in estuaries and coastal bays, from Cairns in Queensland to the Gippsland Lakes in Victoria. They are more commonly caught during the summer months and distinguished from other flathead by the black spot at the end of their tail.
