21.01.2022 My Corona - 16 hr shifts paid for 8 NOT ACCEPTABLE! In this time of uncertainty for many businesses we remind managers and CEO’s of your obligation to treat your staff lawfully. This includes considering their health and safety regarding Corona and your desire to remain open despite the risk of infection to staff.... It’s shocking, but we have confirmed cases of hospitality businesses requiring full time staff to work 14 to 16 hr shifts (paying them for 8hours) and requiring the same full time staff to put off casuals and take on their extra duties, just so the business can save money. It's unsafe, unreasonable and unlawful. This disgraceful conduct seems to be happening to those who don’t feel like they can stand up for their rights most that we have spoken with are also originally from overseas. Thankfully none of these businesses are our clients and if any business or U Migrate client needs our assistance to remain within the employment and immigration Law we are here to help with your strategy. For those in the community who are blatantly taking advantage of full time staff, we remind you of the recent bankruptcy of some ‘hospitality gurus’ and other companies due to staff underpayment. 19.01.2022 My Corona - Entry ban for visa holders As most will be aware, Australia has now closed it's borders to all non-permanent residents or citizens from entering Australia.... this means: If you are outside Australia and are not a PR or citizen of Australia you cannot enter; If you are inside Australia on a temporary visa you cannot re-enter Australia if you leave; if you are inside Australia on a bridging visa - because you applied for another visa (even PR), you cannot re-enter Australia if you leave What if I need to leave to extend my visa? However, it is essential you understand your visa conditions and expiry dates so you can seek relevant assistance. 19.01.2022 OH MY CARD! - Visa cancellation & Your Passenger card This might rattle your bones, but this chap had a employer nominated visa cancelled because he was going home to Lebenon for a holiday and - on his outgoing pasenger card - lied about the amount of money he was taking home. So, the Australian Federal Court has found lying on your passenger card either entering or exiting Australia is grounds for cancellation.... EXTRACT "...On 28 August 2015, the Delegate sent Mr Dalla a notice of intention to consider cancellation of his Visa under s.109 of the Act, particularising Mr Dalla ’s failure to declare in his Outgoing Passenger Card the fact that he was taking more than A$10,000 out of the country. On 14 September 2015, Mr Dalla , through his then solicitor, provided the Department (and inferentially, the Delegate) with a letter outlining submissions explaining why he made erroneous declarations on his Outgoing Passenger Card. 18.01.2022 My Corona - Gatherings from 500 to 100 indoors PM announces gatherings of 500 are still fine for outdoors, but indoors are now down to 100. Some places are still OK for more than 100 - such as education, hospital, office blocks and supermarkets - but it's possibly simpler to stay in doors if you can.... 13.01.2022 CHECK YOUR IMMI! - Immi Account Update Warning The Immi Account is currently warning that after this next update applicants specifically 408 Visa applicants) should re check the immi account for additional questions the Government is adding.... here's the message we get Application statuses in ImmiAccount from 22 April 2020 The Department will be performing several updates to the Temporary Activity Visa (Subclass 408) online application form on 22 April 2020. Applications that are not submitted by 5am Wednesday 22 April 2020 (AEST) will be set to a status of ‘Incomplete’ in ImmiAccount as part of the systems maintenance process. From 22 April 2020, applicants will need to review the answers within their application form to ensure that any updated questions have been answered. My Health Declarations Forms The My Health Declarations (MHD) service is temporarily suspended. The Health Requirement, including the health examinations for your intended visa will be determined once your visa application has been lodged. All incomplete forms will be set to a status of ‘Discontinued’ on Wednesday 22 April 2020 as part of the systems maintenance process.

If individuals or practitioners are involved in current proceedings before the Court (or Administrative Appeals Tribunal) that are impacted by COVID-19, they are encouraged to direct enquiries for assistance, such as necessary adjournments, variations to timetables or preparation for hearings, to a Court or AAT representative. We would extend this isolation advice to those who have recently spent time in any country and feel unwell at all particularly if you have contact with any individual with a immune or respiratory issue. ADVICE Practitioners, litigants and the public visiting court buildings are asked to follow the below advice: if you have left, or transited through, mainland China on or after 1 February 2020, or if you have left, or transited through Iran on or after 1 March 2020, or if you have left, or transited through, the Republic of Korea, on or after 5 March 2020, or if you have been in close contact with a proven case of COVID-19: you MUST isolate yourself at home for 14 days. If you are arriving in Australia from Italy, you must present for health screening at the border as directed.
