06.01.2022 Bail and remand Bail is a process whereby a person who has been arrested and charged with a criminal offence is released from police custody back into the commu...nity on the condition that he or she will return to court at the next related court hearing. Important to know that: Whilst the presumption of bail can be overturned regarding certain kinds of offences, the court is not permitted to make the conditions anymore onerous than the nature of the offence. This means that the conditions of bail are not supposed to be a punishment ( in the sense that it is not reasonable to expect the accused person to comply). Relevant case reference in which I represented my clients charged with commonwealth criminal offences (human trafficking offences on 13 August 2019 at Launceston Magistrates Court: above is the link to the case in which I successfully argued on behalf of my clients that the bail conditions imposed by the inAustralian Federal Police were unreasonable therefore must be removed and varied. The condition that was removed stated ( the accused persons can not change their home address without prior approval of the court. The condition that was varied stated ( the accused persons report only once a week to the Launceston Police Station as opposed to twice a week).
