21.01.2022 The NSW government recently passed legislation that allows for the conditional release of prisoners in an effort to prevent unnecessary over-crowding and stop COVID-19 from spreading into prisons. UNSW Professor Eileen Baldry, member of UNSW Law's Centre for Crime, Law and Justice, says with many facing an inability to practice physical distancing and access proper hand washing facilities, prisoners and staff are at risk of becoming infected in an incubation-like atmosphere s...imilar to cruise ships. Prisoners who are released once their term comes to an end, or staff who are coming and going from the prison, could then spread the infection in the wider community. Prof. Baldry says a reasonable number of NSW prisoners may be eligible for conditional release, however offenders who are in for very serious offences won’t be able to be released under these changes. Instead, the focus is on those who are deemed to be low-risk to the community and where sentences could otherwise be in the form of an intensive community order or probation order. These prisoners are not serious threats to society, they are not violent offenders. If they don't reduce the number of people in prison and the overcrowding in prison, it is only a matter of time until prisons are hotspots for COVID-19.
