In NSW all Courts are bound by the Guideline Judgement for High Range Drink Driving which was an application by the Attorney General pursuant to Section 37 of the Crimes (Sentencing Procedure) Act for a Guideline Judgement concerning the Offe...nce of High Range drink driving pursuant to Section 9 (4) of the Road Transport (Safety and Traffic Management) Act 1999 (No 3 of 2002 {2004} NSWCCA 303. Most persons who are charged with Drink Driving offences come before the Courts with good character. In R v- McIntyre (1988) 38 A Crim R 135 at 139 stated that Good Character has less relevance in such driving offences whereas it may apply in other offending behaviour. In repeat offending behaviour for Drink Driving particularly high range a custodial sentence is a serious consideration for the court, however in the Decision of Pogson, Lapham and Martin and in Heath Andrew Whelan v- R Section 67 of the Crimes (Sentencing Procedure) Act set out the suitability of such an offender for an Intensive Corrections Order. What part does rehabilitation play in sentencing an offender for drink driving offences. In Pogson, Lapham and Martin McClellan CJ at CL and Johnson J set out the meaning of rehabilitation in the sentencing process. One of the frequent cited statements on rehabilitation is that of King J in Vartzokas v- Zanker (1989) 51 SASR at 279. Rehabilitation is aimed at the renunciation by the offender of his/her wrongdoing and in re-establishing themselves as law abiding citizens.
