It is well known that to the mainstream Western media Russian propaganda is the worst of evils and in this logic, a journalist can safely blame it for anything at all without being preoccupied with consistency. Mr. Zappones article is a remarkable case in point. Reading through the rather large text we were unable to find a single reference to any fact substantiating the headline. The only relevant instance would be an opinion of a US expert, cited as saying literally this: It is very likely that RT-promoted narratives are seeping into the Australian information environment via social channels. 13.01.2022 Nothing new, but interesting to notice one more time about conduct of a judges . I had appeared last week before the Supreme Court Judicial Registrar and after 30 minutes a monolog about how bad I am and that I should be referred to LSC, I had to intervene and to remind about judicial impartiality, impersonal attitude and expected exercise of "justice" not a personal hate towards particular officer of the Court. At least, it helped to release "steam" and to finish matter with quite successful result.

All practicing solicitors will be able to vote since 12th April to elect 2 members out of 18 candidates. It is time for LSB not just to be a rubber stamp for a bureaucrats, but to take an active position. Below some points from my election programme. Sergey Sizenko "Like a number of candidates in this election, I have direct experience of the operations of the Office of the Legal Services Commissioner, and believe that I have the practical and legal skills to oversee improvements at this moment ripe for change with the commencement of a new Legal Services Commissioner. The Commissioner now has the power to compel production of privileged documents in complaints by non-clients. Lawyers’ privilege against self-incrimination is abrogated during the investigation phase and in VCAT. Their insurance does not cover the costs of responding to disciplinary investigations. Disciplinary prosecutions are dealt with by low paid over busy decision makers in VCAT where the rules of evidence do not apply. There are no effective mechanisms for the provision of assistance to lawyers facing investigations and prosecutions, and the costs regime in VCAT is such that costs orders are never made against the Commissioner. This has the result that lawyers who represent themselves, or do not obtain specialist representation, find themselves in financially ruinous circumstances before they know it. Despite this legal and procedural ascendancy of the Commissioner, the investigation and prosecution of lawyers is beset by delay and investigations and prosecutions are not always of a high quality. Great harm to practitioners’ and complainants’ mental health is occasioned by this delay, and frustration with the Commissioner’s office seems to be ever building amongst the profession and clients who come into contact with it. The Commissioner has become, since the introduction of the Legal Profession Uniform Law, investigator and decision maker in relation to costs disputes and many disciplinary investigations. The Commissioner is quietly taxing bills without hearings, and giving fines to practitioners. Not only is the Commissioner more timid in their decision making than the Costs Court, but the whole process is conducted away from the glare of public scrutiny and tends to emphasise compromise of disputes rather than determination according to law. As a specialist costs lawyer who acts for clients and lawyers alike I would like to see a costs law developed which is certain, well-understood by the profession and clients alike, in which the Office of the Legal Services Commissioner is as expert as the officers of the Costs Court so that misconduct in relation to costs, which provides a grossly unfair advantage to unscrupulous lawyers, may be rooted out, and ordinary honest lawyers will not find themselves unexpectedly in protracted disputes replete with legal uncertainty and in respect of which they are uninsured. And I would like to take steps to change the whole paradigm of investigation of disciplinary complaints and costs disputes with an aim of completing each investigation within 60 days of the complaint being properly articulated. I have specialised in costs law since 2008 and have been involved in an epic solicitor-client costs battle through the Costs Court and to the High Court and back which made a great deal of the law about the Legal Profession Act 2004. I am on the panel of the Victorian Workcover Authority and know intimately the terrain of personal injury litigation." Your assistance to spread information around would be greatly appreciated!! 05.01.2022 "Indemnity costs are higher than usual costs orders and awarded in circumstances such as when a judge determines that there has been an abuse of process."- it is not correct statement at all. Indemnity- means "all costs unless unreasonable" to be allowed by the Costs Court , when it taxed. Basis of Costs still will be appropriate Scale of costs, unless the Court Orders some other specific basis( which is very rare).
