12.01.2022 SECURITY OF PAYMENT: SEVERANCE NOW POSSIBLE IN NSW One of the planned amendments to the NSW Security of Payment Act is the ability to sever an invalid portion of an adjudication determination. However, it may not be necessary to wait for this particular amendment following a recent Supreme Court decision in which the Supreme Court expressed the view that the doctrine of severance can apply to an adjudicator’s determination.... The previous position in NSW was that any error would cause the whole determination to be set aside. The adoption of the doctrine of severance by the Court means that if there is an error in an adjudication determination, only the portion of the determination affected by the error will be set aside.
