If an old form is signed by the principal on or after 30 November 2020, the Titles Office will not be satisfied that the document is valid in accordance with the Power of Attorney Act 1998. 18.01.2022 Close enough is good enough? A recent decision in QCAT (NQ Sheds and Patios Pty Ltd v Lanzi & Anor [2020] QCAT 417) earlier this month demonstrates the importance of engaging a qualified surveyor to mark out the boundary of your property. The respondents entered into a contract with NQ Sheds for the construction of a shed on their property.... The contract provided that the site plan was the responsibility of the respondent. NQ Sheds, in consultation with Mr Lanzi (who was a registered builder) produced a site plan that was approved by Mr Lanzi and Mr Lanzi subsequently pegged out the proposed site. The site plan was inaccurate and this resulted in the gutter of the shed encroaching on the neighbour's land by 200mm. The respondent refused to pay NQ Sheds the final payment owing under the contract and suggested that NQ Sheds rectify the error by paying for a boundary realignment. The QCAT Member found that the responsibility of providing an accurate site plan rests on the respondent therefore NQ Shed was entitled to be paid the final payment. The QCAT Member also doubted whether a boundary realignment was the proper measure of damage since changing the guttering for a much lesser cost (which was offered by NQ Sheds) was a satisfactory solution. #virtuallegal #qcat

05.01.2022 Does something smell fishy? Simplot Australia Pty Ltd (Simplot) has amended its labelling on 31 frozen fish products sold under Birds Eye, I&J and Neptune brands from "Made in Australia" to "Packed in Australia" following concerns raised by ACCC. Simplot argued that slicing, crumbing and par-frying the frozen fish constituted substantial transformation justifying the use of the "Made in Australia" mark.... ACCC Deputy Chair Mick Keogh confirmed that "processes that only change the form or appearance of imported ingredients or components no longer qualify as substantial transformation". The decision reflects the importance that Australians place on supporting Australian products particularly where many of us are happy to pay a premium if we think that it is made in Australia.

04.01.2022 ACCC and Franchising Taskforce continues its tough stance on the Franchising sector. The ACCC has recently obtained a court-enforceable undertaking from Bob Jane Corporation Pty Ltd (Bob Jane) to comply with its obligations under the Franchising Code of Conduct (Code). ACCC was concerned that Bob Jane had procured the agreement of several franchisees to enter into a "holding-over" arrangement on a month to month basis. ACCC's view was that these arrangements breached the Code... in that Bob Jane failed to: - notify each franchisee at least 6 months before the end of the term in relation to its intention to renew the franchise agreement; - provide disclosure documentation to the franchisor in the relevant time frame; and - obtain written statements from each franchisee that they had received, read and understood the disclosure documentation. This is a reminder to franchisors that they cannot dispense with obligations under the Code even with the agreement of the franchisee.
