25.01.2022 Over the weekend, Border force updated their categories to confirm instances an automatic or an individual exemption is required to facilitate travel. Exempt categories You are automatically exempt from the travel restrictions and can enter Australia (without obtaining an individual exemption) if you are: an Australian citizen... a permanent resident of Australia an immediate family member of an Australian citizen or permanent resident a New Zealand citizen usually resident in Australia and their immediate family members a diplomat accredited to Australia (holding a subclass 995 visa) a traveller transiting Australia for 72 hours or less airline crew maritime crew including marine pilots recruited under the Government approved Seasonal Worker Program or Pacific Labour Scheme You need to carry evidence that you meet one of the above categories when travelling. Additional evidence may be requested. Individual exemptions The Commissioner of the Australian Border Force may grant an individual exemption if you are: a non-citizen travelling at the invitation of the Australian Government or a state or territory government authority for the purpose of assisting in the COVID-19 response providing critical or specialist medical services, including air ambulance, medical evacuations and delivering critical medical supplies a non-citizen with critical skills or working in a critical sector in Australia a non-citizen whose entry would otherwise be in the national interest, supported by the Australian Government or a state or territory government authority military personnel, including those who form part of the Status of Forces Agreement, Commonwealth Armed Forces, Asia Pacific Forces and Status of Armed Forces Agreement travelling for compassionate and compelling reasons. You must hold a visa and an exemption to Australia’s travel restrictions before you travel. You can request an exemption online and must provide appropriate evidence to support your claims. Requests may be finalised without further consideration if insufficient evidence is provided. All documents need to be officially translated into English.
20.01.2022 COVID-19 Related Visa Application Refunds Prospective Marriage, Pacific Labour Scheme and Seasonal Worker Programme visa holders will be able to access a VAC refund. Temporary skilled workers and visitor visa holders will be eligible to have the VAC for a subsequent visa application waived, to allow them to return to Australia once travel restrictions are lifted. Working holiday makers will be eligible to have the VAC for a subsequent visa application waived, to allow them to return to Australia once travel restrictions are lifted or otherwise be able to access a VAC refund.
19.01.2022 Overall Migration Program Planning Levels The Government will maintain the 2020-21 Migration Program planning level at 160,000. Family Stream places will increase from 47,732 to 77,300 places on a one-off basis for the 2020-21 Migration Program year, and Employer Sponsored, Global Talent, Business Innovation and Investment Program visas will be prioritised within the Skilled Stream. Onshore visa applicants and Partner visa applicants where the relevant sponsor resides in a designated regional area will also be prioritised for the 2020-21 Migration Program.
15.01.2022 Permanent migration New Zealand Pathway to permanent residency - the income eligibility requirement for the New Zealand stream of the Skilled Independent (subclass 189) visa. Eligibility for the Pathway will be extended to Special Category (subclass 444) visa holders who have a taxable income at or above the Temporary Skilled Migrant Income Threshold for at least three of the last five income years, including the most recent year.
13.01.2022 Outcome of last night’s Federal Budget: The Australian government tonight released some detail into its immigration planning for 2020-201 with family visas, employer sponsored visas and business and investment visas the clear winners in terms of priorities among the 160,000 places, however the addition of English requirements for partner visa applicants and sponsors and increased sponsorship requirements and obligations to partner visas threatens to dramatically change the partner visa program. 12.01.2022 Business and Investment Visa Changes From 1 July 2021, the Government will streamline and improve the operation of the Business Innovation and Investment Program (BIIP). The Government will introduce changes to improve the quality of investments and applicants. Visa application charges for BIIP visas will also be increased by an additional 11.3 per cent (above regular CPI indexation) on 1 July 2021.
12.01.2022 Priority Migration Skilled Occupation List (PMSOL) announced Acting Minister for Immigration Alan Tudge has announced a new Priority Migration Skilled Occupation List (PMSOL) of 17 occupations that will be able to enter Australia to assist in the country's COVID recovery. The Acting Minister stated in his joint media release with Senator Michaelia Cash that ...These occupations in the health care, construction and IT sectors will supercharge both our health and economic resp...onse to COVID-19. Visa holders, who have been sponsored by an Australia business in a PMSOL occupation can request an exemption from Australia’s travel restrictions, but will be subject to a strict 14 days quarantine on arrival at their own expense. Labour market testing will still be required to be able to sponsor applicantion in these occupations. 09.01.2022 Partner Visa Changes The Government will apply the family sponsorship framework to Partner visas which will mandate character checks and the sharing of personal information as part of a mandatory sponsorship application, and subject the sponsor to enforceable sponsorship obligations. These changes will complement existing family violence provisions within the Partner visa program. The Government will introduce English language requirements for Partner visa applicants and their permanent resident sponsors. These changes will help support English language acquisition and enhance social cohesion and economic participation outcomes.
07.01.2022 New visa arrangements will provide further opportunities for Hong Kong passport holders to remain in Australia, with pathways to permanent residency. They will also attract talent and companies to our nation in order to boost productivity and create further job opportunities for Australians. Temporary graduate and skilled workers will be offered an additional five years of work rights in Australia on top of the time they’ve already been in Australia, with a pathway to perma...nent residency at the end of that period. Students will be eligible for a five year graduate visa from the conclusion of their studies, with a pathway to permanent residency at the end of that period. . Future Hong Kong applicants for temporary skilled visas will be provided with a five year visa, based on meeting the updated skills lists and Labour Market Testing requirements. Existing arrangement will continue to apply for those applicants who study and work in regional areas to help address skills shortages in those areas, with pathways to permanent residency after 3 years. There are almost 10,000 existing temporary skilled, temporary graduate and student visa holders in Australia who will be eligible for these special arrangements, with a further 2,500 outside Australia and 1,250 applications on hand. The Government will also enhance efforts to attract businesses from Hong Kong. There are more than 1,000 international companies that have their regional headquarters based in Hong Kong which might consider relocating to Australia. 02.01.2022 PARTNER VISA ENGLISH REQUIREMENT The Australian government today announced further details about the shock changes to the Partner Visa program regarding adding English language testing. Acting Immigration Minister Alan Tudge has said that the English changes are intended to apply from the middle of 2021, and will be implemented at the second (permanent resident) stage of partner visa applications. According to media reports Tudge stated today, "What this will mean is that we ...will require an applicant and a sponsor to have met functional level English or to have at least made reasonable efforts to lean English. And by reasonable efforts we mean for most people that would be doing about 500 hours of free English language classes." The announcement was met with relief by many in the community including migration practitioners, however the imposition of this additional requirement still remains a potential obstacle to migrants, especially those who may not be able to pass the required English test and who may for any number of reasons including family responsibilities, health, employment or other reasons be unable to progress through the English language classes. What remains unclear is whether there will be a "buy-out" available if applicants or their permanent resident sponsors are unable to provide evidence of functional English or take 500 hours of English language classes, with one major Sydney newspaper publishing a story yesterday that seemed to indicate that partner visas would be refused if the English language requirements could not be met. It is also unclear at the moment whether exemptions will be made for people who hold certain passports from English-speaking countries or have had a specified level of English education in other countries, whether disadvantaged applicants such as victims of family violence will be held to the same English requirement, and how situations will be handled when an applicant passes the English requirement but the sponsor does not.

01.01.2022 ETA mobile app The Department have announced on their COVID-19 mini website that they are trialling an Electronic Travel Authority (ETA) mobile app (AustralianETA) for some ETA-eligible passport holders while the travel restrictions are in place. As per the information on the website you can apply for an ETA through the app if:... you meet all ETA eligibility requirements and you hold a passport from Brunei, Canada, Hong Kong (SAR of China), Japan, Malaysia, Singapore, South Korea or the United States of America. Before you can travel on an ETA, you must also be exempt from Australia's travel restrictions. Grant of an ETA through the app does not mean you have been considered for or granted an exemption to travel to Australia. You still need to apply for a travel exemption and provide evidence to support your claims. If you are not granted an exemption, you should not continue with your travel plans, as you will not be permitted to board a flight to Australia. Please note that use of the Australian ETA app incurs a non-refundable service fee of $20. An ETA does not allow you to work in Australia, or stay longer than three months.
