25.01.2022 Update & Various Nomination & 186 Visa Granted We get approvals almost daily but having a Nomination and subclass 186 (temporary residency stream) approved in 5 weeks is worth mentioning. ... Migration Agents cannot attest to having a favoured relationship with the Department of Home Affairs but if an application is submitted properly there is no reason why an application cannot be approved quickly. +++ Partner Migration Changes to the way in which Partner visas are processed have still not be implemented.If you are considering a partner visa application then I would suggest doing it sooner rather then later. +++ Worth remembering who the First Migrants to Australia were Aboriginal people have lived in Australia continuously for 50,000 years. 23.01.2022 Honesty is important when preparing a visa application. In my career as a Migration Agent I can recall a number of clients who were not honest with me or the Department of Immigration. Two clients come to mind. The first client, from Northern Ireland, failed to tell me that he had gotten into a bar fight and accidentally killed a man. He had been charged with involuntary man-slaughter. This became apparent when he provided to me his police certificate. This changed our entir...e approach to his visa application which, I am pleased to say, was approved. Had he advised me of this incident when we first met it would have saved a lot of time and expense. The second client, from Spain, forgot to mention that she had a pace-maker installed to regulate the contractions of her heart. This became apparent to me and the Department of Home Affairs when she completed her health examination and was referred to the Commonwealth Health Officer. Again, the visa was approved. Having previous criminal convictions or health concerns will not necessarily prevent a visa application from being approved. However, providing fraudulent documentation or unsuccessfully trying to deceive the DHA will! Honesty is the best policy to adopt when dealing with Australian Immigration. 18.01.2022 Migration Services - Fees and Charges Every day I am contacted by people considering making a visa application to come to Australia or remain in Australia. After a careful consideration of their situation I will provide to them detail's of my planned strategy along with the fees that will be charged by the DHA (Department of Home Affairs) and my professional costs.... In early August a repeat client of mine contacted me once again to assist their business with a (1) Skilled nomination application and (2) a subclass 482 visa application for two of their staff. This week, some 6 weeks later, they contacted me to advise that my quote was almost double the amount of another quote they had received from another migration agent. They wanted to use my services but wanted to know why my professional charges were so much higher. My client provided to me a copy of the quote from the other migration agency. The agency shall remain nameless but it is safe to say that they are one of the largest migration agencies in Australia and employ hundreds of registered agents. Their initial cost was very low. However, upon reading their 15 page quote it became apparent that their cost did not include assistance with some of the basic requirements associated with a nomination and 482 visa application. Additional costs would be incurred (amounts not stated) to assist with Labour Market Testing, Genuineness, DHA requests for further information, issue with contracts of employment etc. The list went on and on and on until it ended on the 15th page. I felt that the agreement was deliberately misleading. It would get the client on-board on the basis of being cheaper but the cost's would quickly escalate to be - I expect - much higher then originally quoted and probably higher then my quote. It also opened up the possibility for the migration agent to exploit the clients limited knowledge of these applications and charge unnecessary costs. Transparency is important and a client should be aware at the beginning of what the entire process is likely to cost them. 13.01.2022 SKILLED MIGRATION REVIEW The federal government has launched a major review into the skilled migration occupations list, with hopes that new tech job categories will be included in the mainstream program. Employment Minister Michaelia Cash says skilled migration is needed to support the government $100 billion infrastructure roll out.... The review will inform the governments updating of the occupations list in March next year, with labour market analysis and public consultations to also be undertaken. Immigration minister David Coleman said the new review aimed to ensure that businesses can access workers to fill critical skills shortages. The Morrison government is continuing to look closely at ways of filling these skills gaps in regional areas and giving businesses more certainty and confidence that they can get the workers they need, when they need them, Mr Coleman said. In an effort to bypass this, the federal government made the Global Talent Employer Sponsored visa scheme permanent earlier this year. The scheme, designed for tech companies to attract overseas workers for niche, high-skilled jobs, is not restricted to the occupations list. A 12-month pilot of the GTES scheme saw 23 companies enter into an agreement with the government to access fast-tracked visas for jobs not included in the skilled migration occupations list. As part of the review the ANZSCO will also be revised and it can be expected that some new job categories are introduced. This will then enable their inclusion into a revised SOL (Skilled Occupation List). With the introduction of two new regional visas in November 2019 and the announcement of this review to occur by March 2020 it is certainly going to be an interesting time. This area of migration to Australia is, and will continue to be, a dynamic and competitive steam of immigration.
