25.01.2022 Its fair to say Covid-19 has major impacts on a global scale. For our Employer Clients, given the economic impacts of COVID-19, the Australian Government has a strong expectation that positions will be advertised on Jobactive (which is a government recruitment website linked to Centrelink) as well as two (2) other national recruitment websites for at least 28 days before lodging a nomination, to try and source suitable qualified experienced Australian workers BEFORE seekin...g to nominate an overseas worker for the permanent employer sponsored visa (subclass 186). This is in order to demonstrate that there is a genuine need for an overseas worker to fill that position. The Department will be scrutinising Employer Nominations in relation to Australian workers employed by the business in similar occupations by checking the below: Retrenchments in the previous 12 months Reduction of hours worked during the previous 12 months Reduction in pay and conditions within the previous 12 months Employment of a temporary visa holder on conditions less favourable than Australians Recruitment of temporary visa holders beyond the ordinary scope of the business. Its like everything else with Covid-19, it's all managed on a daily basis depending on numbers, economy recovery, Victoria getting back to work and getting on the road to recovery! 21.01.2022 Listening to the Owner of the Waterwheel Tavern in Lakes Entrance this morning who simply can't get 4 x fully qualified trained experienced chefs in Regional Victoria. What does he do? He shuts his business for a couple of days per week to give existing staff a break, which is crazy given the bulk of Melburnians head into regional areas for well deserved breaks post lock-down. The impacts of Corona virus is felt far and wide for businesses across Victoria (and Australia in g...eneral) but in particular Regional areas. Thousands of Skilled Migrants departed Australia back in March and simply can't return. 19.01.2022 Home Affairs published the 2019-20 Migration Program Report. Below is a summarised version of the report. The total places granted for the permanent migration program in 2019-20 is 140,366. The total places granted in the humanitarian program in 2019-20 is 13,171. ... 70% of visas were granted through the skilled stream with 95,843 places in total, which includes 4,109 places under the highly skilled Global Talent. 23,372 regional visas delivered, from the 25,000 places allocated for the subclass 491 and 494 subclass visas. 41,961 visas granted in the Family program, including 37,118 Partner visas. 81 places in the Special Eligibility stream. 2,481 places in the Child stream. Two-thirds of permanent visas were granted to individuals already in Australia who transitioned from a temporary visa to permanent residency (subclass 186 under the Employer Nomination Scheme) COVID-19 had a significant impact on the outcome of the 201920 Migration Program, due to disruption of services such as English Language testing, biometrics, health and character checking. Categories that reached planning ceilings were Distinguished Talent and Skilled Work Regional (within the Regional category). Overall Migration Program lodgements dropped by 12.3 per cent from 198,710 in 201819 to 174,170 in 201920. In summary of the total amounts for the humanitarian program: Of the total including 4,765 visas (45 per cent) for those who were referred for settlement in regional areas. There was a total of 11,521 of offshore visas granted and 1,650 of onshore visas granted. 6422 were refugee category visas. 5099 were special humanitarian category (SHP) visas. The size of the 2020-21 Migration and Humanitarian programs will be considered as part of the Budget being handed down in October by the federal government. Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs Alan Tudge has announced that from 15th November 2020, there will an updated Australian Citizenship Test with a clear focus on Australian values. The Acting Minister stated The updated Citizenship Test will have new and more meaningful questions that require potential citizens to understand and commit to our values like freedom of speech, mutual respect, equality of opportu...nity, the importance of democracy and the rule of law." The updated Citizenship Test will comprise of 20 multiple-choice questions, including five (5) questions on Australian values. A person will be required to correctly answer all five (5) questions on Australian values, with a mark of at least 75 % overall, to pass the test. There will be no changes to the English language or residency requirements for citizenship. An updated version of the Australian Citizenship: Our Common Bond resources is available for download to assist applicants prepare for the test. This includes information on the new Australian values component and an updated practice test. From 30 October 2020, new citizenship applicants will be required to affirm the updated Australian Values Statement (AVS). 16.01.2022 Hi everyone! This update is for tradies going through the skills assessment process with TRA (Trades Recognition Australia) via VETASSESS. Due to Trades Recognition Australia’s end of year shutdown, all skills assessments completed after 9th December will not be finalised until 2021. They will continue processing pending applications until 18th December; however, the outcomes will not be released until the second week of January 2021. Priority Processing applications on ho...ld VETASSESS Priority Processing service for general professional occupations will be suspended during the shutdown period. They will not accept priority processing applications from 2nd December 2020 until 3rd January 2021, but normal service will resume on January 4, 2021. The last day for submitting priority processing applications is COB (close of business) 1st December 2020. We have quite a few trades occupations in progress and there is no impact to those clients. 12.01.2022 The 2020-21 Federal Budget papers predict net overseas migration will be -71,200 less than the 154,000 persons in 2019-20, and expected to gradually increase to 201,000 in 2023-24. See below breakdown for your info Migration Program levels... The current Migration Program Planning level will remain at 160,000 for the 2020-21 program year, and the distribution of places will change and increase from 47,732 to 77,300 for Family stream places for this program year only. Employer Sponsored, Global Talent, Business Innovation and Investment Program visas will be prioritised within the Skilled Stream. Onshore visa applicants and Partner visa applicants where the relevant sponsor resides in a designated regional area, will be prioritised for the 2020-21 Migration Program. Temporary skilled workers and visitor visa holders will be eligible to have the (VAC) Visa Application Charge for a subsequent visa application waived, to allow them return to Australia once travel restrictions are lifted. Business, Investment and Innovation Program (BIIP) The Government will introduce changes to improve the quality of investments and focus on higher value investors. Global Talent Independent program Places in this program will be tripled to 15,000. A new whole-of-government Global Business and Talent Attraction Taskforce will be established to attract international businesses and exceptional talent to Australia to assist recovery. Family stream program and visas Partner visas - the mandatory family sponsorship provisions for Partner visas will be implemented, mandatory character checks and sharing of personal information with the applicant, and enforceable sponsorship obligations. 72,300 of the 77,300 places in the family stream will be allocated to partner applicants. This is NATIONALLY across Australia and based on the "highest" points scores. Absolute minimum points entry is 65, but only those with 105 points or above generally get invited to apply! Home Affairs select the "brightest and the best" so the higher your points the better your chances are of getting an "invitation to apply" for the subclass 189. Plea...se know that just because you lodge an "invitation to apply" doesn't mean you get a Bridging Visa. The Bridging Visa is only ever tied to the "invitation to apply" and NOT the Expression of Interest. Hope this clarifies and eliminates confusion. The Government is under increasing pressure to do all it can to bring them home by Christmas. 3,000 are currently classified as vulnerable for health or financial reasons! ... 4,000 cap Sydney limit of 350 passenger arrivals per day; Perth limit of 525 passenger arrivals per week; Brisbane limit of 500 passenger arrivals per week; Adelaide limit of 500 passenger arrivals per week; Canberra, Darwin passenger limits on each flight to be discussed with jurisdictions on a case-by-case basis; Hobart no international flights. The suspension of international flights into Melbourne will also continue indefinitely until further notice. 10.01.2022 Hi everyone, Latest update from this weeks seminar! 1. The Distinguished Talent Visa (subclass 124) is now CLOSED to all new applicants from November 14th. ( an example of a distinguished talent visa would be an international cricketer who competed and represented their Country at an international level and is well known in the profession) ... 2. Family Violence provisions now applies to all SECONDARY visa applicants at time of application. Prior to this it was only primary applicants. 3. Labour Market Testing (LMT) now applies to ALL employers for 3 visa types. The Subclass 482 temporary visa, the subclass 186 permanent visa and the subclass 494 regional temporary visa. This means from October 1st, if a role is available for the Employer Nomination Scheme for PR (Permanent Residency) subclass 186 either via direct entry OR transition (TRT), the role MUST be advertised on THREE (3) national recruitment websites for an absolute minimum of 28 days. One of those national recruitment websites MUST be a site called "JOB ACTIVE" which is the government website to ensure every effort is made to place Australian Permanent Residents and Citizens into the role first. The employer must demonstrate "genuine need" for that position. The job active recruitment website is the government website directly linked to Centrelink (Social Services Department) The link for Job active is here https://jobactive.gov.au/ and the employer must register and place the advertisement for the role outlining occupation title, salary range and that it's full time ongoing. This also applies to the Subclass 482 and the new subclass 494 Regional visa. Item 8 of the Instrument requires the nominated position at: 3(a) to be advertised on the Employment Department's Jobactive, and; 3(b) to be advertised on or in one or more recruitment websites, in the print media, on radio or on accredited sponsor website. The Instrument LIN 18/036 requires a minimum of two (2), not three (3) LMT advertisements for the nominated position. All nominations lodged on or after 1 October 2020 will require advertising for 4 weeks (28 days) on Jobactive and by one other national recruitment webiste such as Jora, or Indeed. Jobactive is the government recruitment website linked to Centrelink to ensure every effort is made to source a suitably qualified / experienced Australians to fill the role before temporary visa holders. Nominations can NOT be lodged until the 28 days advertisements have run, otherwise the application will be refused.
