19.01.2022 We’re nearly halfway through February though you’d be forgiven for not noticing considering how much has been going on this month! We’ve summarised some of the key developments of the last week below. The ACCC has announced that a lack of ‘competition, choice, and transparency’ in the digital advertising industry is adversely affecting publishers, advertisers and consumers. In particular, Google’s significant share of revenue and ads on digital platforms means it is ‘like...ly to have the ability and the incentive to affect competition.’ The ACCC’s interim report on the Digital Advertising Services Inquiry proposes a number of options for addressing this issue if you are interested, it is available on the ACCC website. We will be providing further updates and articles on this important and developing law reform. In more bad news for Google, their disagreement with Australia’s proposed new Media Code shows no sign of resolution. Last Friday, Google launched their ‘Google News Showcase’ platform in a bid to show publishers how their alternative to the new Code would work. The move has been criticised by many as proof that Google is unwilling to negotiate with the Australian Government, with Nine refusing to participate in the launch. Unfortunately for Google, it appears that the launch has had little impact on the government’s motivation to pass the new Media Code. Perhaps Google will indeed withdraw their search engine from Australia? Stay tuned for more information on the Code in the coming weeks. The Superbowl went ahead this week, and as usual, the advertisements were just as reported on as the game itself. This year’s collection revealed the ways the advertising landscape has changed in the past year. Although car manufacturer Jeep did manage to secure Bruce Springsteen for its emotive ‘ReUnited States of America’ campaign, many other major brands gave way to a range of ‘advertising newcomers’ such as online food delivery company DoorDash and digital brokerage start-up Robinhood. Does the high number of newcomers reveal permanent changes in the advertising space, or did these newer companies merely fill a space that traditional companies temporarily vacated due to the pressures of COVID-19?
