20.01.2022 MEDIA RELEASE 25 October 2018 VICTORIAN FIRST NATIONS RALLY 12.30PM FRIDAY 26 OCTOBER 2018 Birrarung-Marr-Melbourne... 1. First Nations and Clans call on the State Government and Treaty Commissioner to reinforce self determination by ensuring all 38 Victorian First Nations have an automatic seat and funding on the proposed Victorian Aboriginal Representative Body. A First Nations Rally is being held at Birrarung Marr tomorrow. 2. The VTOLJG will not support a model that is exclusive to Registered Aboriginal Parties (RAPs) appointed by a Government appointed Victorian Aboriginal Heritage Council which has only appointed 11 RAPs in 12 years. This is tantamount to unlawful discrimination on the 27 Nations who do not secure an automatic seat on the ARB. 3. Eleven First Nations who are appointed as Registered Aboriginal Parties by the government appointed Victorian Aboriginal Heritage Council have automatic seats on the ARB. In effect, the State is appointing them and this flies in the face of First Nations Democracy, Self Determination and human rights conventions. Some of these RAPs have questionable cultural authority and do not act for the bulk of their First Nations people. 4. Accordingly, to prevent the wrong People in the wrong Country from entering into Treaties, the State must fund a mapping First Nations Clans project that identifies the right People in the right Country. Last week, the Taungurung native title agreement received heavy criticism for their failure to negotiate with the right People over the right boundaries. This claim is fast heading to the state and federal courts. A moratorium on all claims must be done until such time a First Nations Clans mapping project is completed. 5. Additionally, the Victorian Traditional Owner Land Justice Group also calls on the State to directly fund unfunded First Nations Corporations for a Secretariat and operating costs so they have the capacity to operate at a professional level and meet all their native title, cultural heritage, Treaty aspirations and statutory and funding requirements. It is time the State stopped using unresourced and unfunded organisations as an excuse to unlawfully discriminate against First Nations not in the RAP loop. The State must fund First Nations like Governments do for Indigenous health or local community based organisations who are funded annually. 6. Finally, the VTOLJG is calling for a Royal Commission into Aboriginal Affairs including the mismanagement of the native title and cultural heritage industry.
