22.01.2022 Recently, owners of a Bondi apartment building converted unused store rooms on common property to saleable units, to fund an upgrade of their building. Levies aren’t considered taxable income for strata schemes, however profits or income from the sale or leasing of common property are. So if your strata scheme has any income apart from levies, your strata manager or scheme’s accountant, should be calculating a figure that you should declare on your annual tax return.

19.01.2022 FAQ | Our by-laws don’t deal with things I think are important. What can I do? A: You can draft your own by-law to be discussed in the next general meeting. A new by-law requires a special resolution (75% or more to vote in favour). If and when passed, the by-law must be registered with NSW Land Registry Services, making it an enforceable by-law that must be obeyed. You may want to get assistance from your managing agent or a solicitor.

16.01.2022 Pet owners are celebrating the NSW Court of Appeal ruling that overturned the right of unit blocks to create bylaws prohibiting animals. The decision followed a four-and-a-half-year battle from one Sydney pet owner, who fought to keep her miniature schnauzer in her apartment in The Horizon building in Darlinghurst. The court ruled that pets do not adversely affect other occupants, ruling the pet ban seemed to be for the convenience of the strata committee.... What are your thoughts on this decision?

08.01.2022 FAQ | Can I complete required repairs to common property? A: Only if you have permission from the owners corporation. However, common property repairs should be completed by the owners corporation, rather than an individual owner.

04.01.2022 A new code of conduct for short-term rentals in NSW includes a "two strikes and you're out" policy that may result in problematic hosts and guests being banned from holiday letting for five years. The industry code will apply from December 18, 2020 and includes standards to be followed by hosts, guests, letting agents and online booking operators.

Under most strata titles, the owners corporation usually has a set of by-laws that prohibit the storage of hazardous materials. 01.01.2022 As part of the 2020-21 NSW state budget, the NSW Government has announced a three-year program, Project Remediate, to help remove combustible cladding from hundreds of the most at-risk residential buildings in NSW. The program will provide building owners with "high-risk combustible cladding" with access to interest-free loans solely for the use of rectifying combustible cladding on residential apartment buildings. The minister said $139 million had been allocated by the stat...e government for the co-ordination of remediation works for affected buildings, with the priority of removing unsafe cladding from buildings as soon as possible. At the heart of the funding is a government commitment to paying the interest on loans by commercial lenders to building owners and owners corporations to fast-track the removal. The government said further details on the project will be released in December, with applications expected to open in March 2021.
