16.01.2022 ESTATES What happens to your estate when you pass away? You may think that your spouse, family or loved ones can automatically take over for you right away but this is not necessarily true.... When you pass away with a Will then your executor may be required to obtain a "Grant of Probate" from the Supreme Court of Victoria which allows them to act in accordance with the terms of your Will. If you pass away without a Will (known as dying "intestate") then your loved ones will have to decide who would be best administrator to handle your estate and then they may need to apply for "Letters of Administration" from the Supreme Court of Victoria instead. Once your executor or administrator has the Grant of Probate or Letter of Administration, then they will have the authority to handle the distribution of your estate (property, bank accounts, personal belongings, etc).
