19.01.2022 Are you looking at purchasing an existing property that might have been renovated or had improvements such as, extensions, patios, decks, pergolas, driveways, garage, carports, pool or spa added? Buyer Beware! Making a Contract subject to property searches can save you money and time and prevent on-going problems. Unless specific conditions are included, the Standard REIQ Residential House & Land Contract in Queensland does not contain any provision which allows home-buyers ...to terminate the Contract if any unapproved structures are found after the Contract is signed. Standard Condition 7.6 of the standard REIQ Residential House & Land Contract states that any valid notice or order by any competent authority (such as local Council) must be fully complied with: 1. If issued before the Contract date, by the Seller...; 2. If issued on or after the Contract date, by the Buyer. That means that the home-buyer assumes liability for any unapproved alterations or improvements to the dwelling revealed after a Contract is signed. Such liability may include the cost of engaging a qualified Certifier, obtaining Council approval or even demolition of the structure if it fails to comply with the prevailing Councils regulations. While most (if not all) home-buyers elect to undertake a Building and Pest Report, it is not the role of a Building Inspector to review Council approvals of property improvements. Their role is to evaluate the structural integrity of the property and to report as to the existence of any major or minor defects, potential health and safety issues and whether the property (and improvements) meets current standards. If you are considering purchasing an existing property we strongly suggest that you contact White Jordin before you sign a Contract. We are able to draft various Special Conditions to meet your specific needs, at no extra charge to you. Our fees are capped at a set rate, regardless of the property location, purchase price or whether the property is meant as your principal place of residence or as an investment property. Special Conditions allow the home-buyer time to undertake recommended searches with the prevailing Council (such as Approved Building Plans) to check for any unapproved structures and, if found, the home-buyer may have the option to terminate the Contract (and have the deposit refunded in full), or to enter into negotiations with the Vendor. Periods of isolation and social distancing requirements have had a substantial impact upon most services, including the suspension of the Justice of the Peace (JPs) in the Community Program. ... As a result of the current pandemic, new Acts and Regulations have come into force, in particular the COVID-19 Emergency Response Act 2020, and the Justice Legislation (COVID-19 Emergency Response-Wills and Enduring Documents) Regulation 2020 (the Regulation). The Regulation allows for the electronic signing and witnessing of a number of documents during the COVID-19 pandemic, including Affidavits, Statutory Declarations, Deeds, General Powers of Attorney and certain Mortgage documents. The objective of the Regulation is to reduce physical contact between persons during the COVID-19 emergency; and to prescribe modified arrangements (which will apply in addition to existing requirements) for the making, signing and witnessing of Wills and enduring documents. 11.01.2022 The festive season is upon us, kids have started school holidays and many of us are winding down for the year and looking forward to having a well-earned break and catching up with family and friends. Our roads are generally a lot busier during this period, and it is important to take extra care and be mindful of the fatal five: Speeding; Fatigue; impaired driving (drink and drug); ... failure to wear a seat belt; and distraction or inattention. Road safety is every drivers responsibility. If you are planning a long trip, take time to check your engine (water and oil), brakes and tyres. Dont rush! Allow enough time for your intended drive. Watch your speed! Current first offence penalties for speeding, as at September 2018, are: Less than 13km/h over the speed limit = $174.00 fine and 1 demerit point 13km/h to 20km/h over the speed limit = $261.00 fine and 3 demerit points 20km/h to 30km/h over the speed limit = $435.00 fine and 4 demerit points 30km/h to 40km/h over the speed limit = $609.00 fine and 6 demerit points More than 40km/h over the speed limit = $1,218.00 fine and 8 demerit points In Queensland double demerit points apply to drivers and motorcycle riders who repeatedly commit specific offences that increase road safety risks. Unlike other States, in Queensland double demerit points apply all year round as a way of discouraging drivers from continuing unsafe driving practices. This system specifically targets seatbelt offences, motorbike helmet offences, and speeding offences of more than 20km/h over the signed speed limit. Speeding penalties for second offences are: 20km/h to 30km/h over the speed limit = $435.00 fine and 8 demerit points 30km/h to 40km/h over the speed limit = $609.00 fine and 12 demerit points More than 40km/h over the speed limit = $1,218.00 fine, 16 demerit points and 6 months suspension Dont be distracted! Use of Bluetooth / hands-free is only permitted for drivers who hold an open licence, or a P2 provisional licence. Driving whilst using a mobile phone held in your hand is illegal; even if your vehicle is stationary in traffic. As a first offence, you will face a fine $391.00 and 3 demerit points. Repeat offenders caught using a mobile phone within the same 12-month period will incur a further monetary fine and 3 demerit points for the second offence, plus an additional 3 demerit points (double demerit). Learner drivers and P1 provisional drivers under 25 are not permitted to use a mobile phone (whether hands-free, wireless headset or loudspeaker function) at any time whilst operating a vehicle. Be aware! Police will be out in force over the Christmas period, blitzing with radars, highway patrols, RBTs, and targeting speeding, drink driving, use of mobile phone whilst operating a vehicle. 08.01.2022 The National Disability Insurance Scheme (NDIS) has been progressively taking effect in Queensland since January 2016 and will be operating state-wide by July 2019. What is the NDIS? Under the NDIS, block funding provided to disability service provider organisations by the government will instead be provided to individuals with disabilities based on their individual needs. This gives individuals with a disability a greater choice and control over when, where and how they rec...eive the support they need. What does the NDIS mean if I have sustained a personal injury? The NDIS encourages people with a disability to be supported to receive supports outside the NDIS, and be assisted to co-ordinate these supports with the supports provided under the NDIS. If you have received a personal injury that is compensable, for example a motor vehicle accident, then under the NDIS you may be required to take action to obtain compensation for your injury. If you fail to take action to obtain compensation after receiving notice in writing to do so, any support plan that is currently in place under NDIS is suspended until you take action, or if you do not have a plan yet, in the future the plan will not come into effect until you take action. There will be a specified time in which you must take action to take compensation. If you still then fail to take action within that time, the NDIS CEO may take action to claim or obtain compensation on your behalf, or take over the conduct of any existing claim.
