18.01.2022 Victorian eviction moratorium extended to 31 December 2020 The Victorian Government is extending eviction moratorium laws to provide greater certainty for tenants and landlords. Extension of these laws will ensure that Victorian renters facing hardship due to the coronavirus (COVID-19) pandemic will not be evicted from their homes (with limited exceptions) or have their rent increased until 31 December 2020. In addition to the eviction moratorium extension, further support ...being introduced for residential and commercial tenants and landlords includes: changes to the land tax relief scheme and an increase of land tax discount from the current 25 per cent to 50 per cent for residential landlords who provide a 50 per cent rent reduction to eligible tenants extension of the Rent Relief Grant program to 31 December 2020, increasing the maximum grant amount to $3,000 for new applications, and allowing previous recipients to receive up to an additional $1,000 extension of the Residential Tenancies Dispute Resolution Scheme until 31 December 2020. Residential tenants and landlords who are finding it difficult to strike a deal over rent reductions have access to the free dispute resolution service run by Consumer Affairs Victoria for residential tenancies, which has provided advice and dispute resolution services more than 80,000 times since it was launched in April 2020. We encourage you to ensure your networks are aware of the Residential Tenancies Dispute Resolution Scheme that is available to all Victorians and encourage landlords and tenants to revisit their previous agreements, if any, in light of the new arrangements. From 1 March, 2020:... vendors and agents cannot knowingly conceal any material facts about a property when selling land vendors and agents cannot hold public auctions of land before 1pm on Anzac Day, with fines of over $16,000 for non-compliance there is greater protection for people who purchase options to buy land as part of a land banking scheme, including a requirement that money paid be held in trust pending the registration of a subdivision plan there is a ban on some rent-to-buy arrangements, as well as new offences relating to terms contracts, with potential jail time for those who disobey the laws. 13.01.2022 NEW RENTING REQUIREMENTS From 19 June 2019, two reforms to Victorias renting laws will come into effect: 1. Rent increases limited to once per year... Under all new tenancy agreements (fixed-term and periodic), you can only increase the rent once every 12 months, rather than six-monthly intervals. Six-monthly increases will only be allowed for: existing fixed-term tenancy agreements of less than five years, and existing periodic (month-by-month) tenancy agreements. (In both cases, this applies to agreements entered into before 19 June 2019). 2. Providing the renting guide electronically You will have the option to provide the prescribed renting guide Renting a home: a guide for tenants electronically to tenants who have consented to receive information this way. Previously, the requirement was to provide the guide as a printed booklet. To provide the guide electronically: ensure you have the tenants written consent to receive notices and other documents electronically. 10.01.2022 NEW LAWS ON PETS IN RENTED PREMISES START 2nd of MARCH Landlords take note of the following important information from by Consumer Affairs: From Monday, 2 March 2020, new laws mean it will be easier for renters to have a pet. ... Renters can keep pets at a rental property, with the written permission of the rental provider (landlord). Rental providers can only refuse permission with approval from the Victorian Civil and Administrative Tribunal (VCAT). Under the law, a pet is any animal except an assistance dog. Do the new laws apply to pre-existing pets? The new laws do not apply to rental properties that already have pets. If a renter has a pet before 2 March 2020 in the rental property, there is no need to seek the written consent of the rental provider again. However, if the renter wants to bring a new pet into the property, they must request the rental providers consent in writing. They must use the Consumer Affairs Victoria pet request form. Renters can do this by email if both parties have agreed to communicating in this way. Before seeking consent, renters should check that the pet they intend to keep complies with existing council laws or other laws. These laws still apply regardless of whether the rental provider consents to the pet. Refusing consent A rental provider cannot unreasonably refuse consent to a renter wishing to keep a pet. If a rental provider wants to refuse, they have 14 days to apply for a VCAT order. VCAT may order that, either: the rental providers refusal is reasonable and/or the pet should be excluded from the property (meaning the renter cannot keep the pet on the premises), or the renter can keep the pet. If the rental provider does not apply to VCAT within 14 days of receiving the written request, they are taken to have consented to the request. What reasonable grounds will VCAT consider? Before arriving at a decision, VCAT may consider the following factors: the type of pet the renter wants to keep, or is keeping, on the property the character and nature of the property itself, including appliances, fixtures and fittings whether refusing consent to keep the pet on the property is allowed under any Act. Pet-related damage If a pet damages the rental property, the renter must repair any pet-related damage that goes beyond fair wear and tear. 07.01.2022 For anyone not clear what the COVID-19 stage 2 measures banning property auctions and open inspections mean when it comes to what you can do as a Buyer, Seller, Landlord or Tenant, I have copied the Consumer Affairs Victoria notice below. Auctions and open-for-inspections for residential properties: Real estate auctions and open inspections of residential properties are banned from midnight 25 March, to combat the spread of coronavirus (COVID-19).... Estate agents still conducting sales of residential properties must move: their auction processes online, or to a private sale process. Private appointments for inspections for residential properties Private inspections by landlords and agents with individual buyers or individual potential tenants are not banned at this stage, but agents should ensure high levels of hygiene in line with DHHSs advice on cleaning and disinfecting. When conducting a private inspection for residential properties, we recommend vendors and agents use: online inspections private appointments for viewings, and private sales processes. If you must attend a residential property If you must attend a residential property, you must: obey social distancing rules, including standing at least 1.5 metres apart practice good personal hygiene including: o cleaning your hands thoroughly for at least 20 seconds with soap and water, or use an alcohol-based hand sanitiser o covering your nose and mouth with a tissue or a flexed elbow when coughing or sneezing o ensuring properties (particularly high traffic areas such as doors, cupboards, wardrobe handles and stair rails) are clean and disinfected. DHHSs information on appropriate cleaning and disinfecting. Estate agency places of business Estate agent offices can currently remain open for business but must: adhere to social distancing rules, and have processes in place to ensure high levels of hygiene in their workplaces. DHHSs advice for businesses. Inspections for the lease of residential property The Government has not banned open for inspections for the lease of residential property as part of the COVID-19 stage 2 shutdown. It is recommended that only private inspections by appointment occur, exercising the relevant precautions as set out for inspection of properties for sale. From midnight, 25 March 2020, these are as follows: While open-for-inspections for the lease of residential property are not banned, it is recommended that only private inspections by appointment occur. Agents should have processes in place to ensure high levels of hygiene in line with DHHSs advice on cleaning and disinfecting. Agents should ensure that high-touch areas (such as door, cupboard and wardrobe handles, stair rails etc), are cleaned and disinfected before and after each inspection.
