21.01.2022 It is now widely known that one of the negative impacts of the COVID-19 crisis that we have all experienced this year, has been an increase in family violence. On Friday, 25 September 2020, the NSW Attorney General announced that an amendment has been made to Section 316 of the Crimes Act in NSW. This Section previously required a person who knew or believed that a serious indictable offence had been committed such as sexual or domestic violence, was required to report that ...violence to the NSW Police. Under the previous legislation, the failure of front line workers, such as domestic support workers and counsellors, together with family or friends of adults who this violence was disclosed to, were at risk of being charged themselves if they did not have a reasonable excuse for withholding this information and this charge carried a maximum penalty of up to 5 years imprisonment. What these changes mean for victims of family violence, is that they can now seek much needed support without fearing that the people that they disclose their situations to will be at risk of criminal prosecution themselves. In the Sutherland Shire we are not exempt from family violence in our community, with Sutherland Shire Council reporting that Engadine, Menai, Caringbah and Cronulla are the suburbs within our Shire with the highest reported incidences of domestic violence (at last count).
