05.01.2022 If you inherit a property, do you have to pay Capital Gains Tax? Generally, there will be no Capital Gains Tax in relation to the deceaseds dwelling if the property passed to you as a beneficiary of the estate and if it was the deceaseds main residence, and you dispose of it within two years of the deceaseds death. The ATO may extend the two-year period. The ATO has published a Practical Compliance Guideline which discusses the discretion to extend the two-year period.
