25.01.2022 Has your TPD claim been disputed? In some cases the insurance company may dispute your claim, which means that they intend not to pay it out. There are usually several reasons why this could be happening. Varied definitions - this means that the insurer does not believe you have satisfied the definition of TPD or the required level of disability. Waiting periods - some insurers enforce waiting periods before a payment is made. This means you might not be able to access ...payment straightaway. Exclusions - TPD doesn't cover everything. For example, it may not cover certain pre-existing conditions or positions which may be considered hazardous, etc. Ongoing requirements - the insurer may have special ongoing requirements and will only pay out if you meet these requirements (such as undergoing a specialist rehabilitation program, etc). Employment requirements - this means you do not fulfil work history requirements. Good news, not all is lost. In many cases, we are able to challenge the insurers' decision and get the claim back on track. https://wkblawyers.com.au/ 1800 865 225

25.01.2022 I dont know where to start. I was trying to claim my retrospective invalid claim through my super. I had no help from them and they were just telling me to withdraw my super and not make the claim. We got approved within 3 months, and Im so thankful. So so happy!... - Tracey D.

25.01.2022 You think you have a TPD claim, so you sought the opinion of a financial planner or lawyer just to have been told NO? Warren, our principal lawyer, will personally review your case and if there is a way to get the claim approved he will find it! 25.01.2022 While mental illnesses are the third leading cause of disability in Australia (affecting around one in five Australians and costing billions in health care), insurers are still wary of mental health disability claims and it can be difficult to get cover for such claims. However, TPD insurance in your superannuation fund will often pay out the claim if you had to stop working due to a mental health condition. So if you can no longer work due to a mental health condition and are considering lodging a TPD claim, give us a call on 1800 865 225 for a free review of your case and see how he can help. https://wkblawyers.com.au/

24.01.2022 "I was very pleased with the hard work Warren put in to achieve a successful outcome with my trauma claim. The insurer had more or less told me I did not meet the definition for the auto immune disease I have. Once I appointed Warren to act on my behalf, things really changed. Thank you so much Warren!"... -Julie B.

24.01.2022 Did you know that the leading cause of blindness in working-age Australian adults is diabetes? Diabetes can lead to significant physical and mental health complications. 22.01.2022 TPD and TPD only. Unlike other law firms that tried to do everything, we focus on what we are great at - helping people with Total and Permanent Disability Claims. 22.01.2022 Multiple sclerosis and online support. One of the conditions we come across when dealing with TPD claims is Multiple Sclerosis. Its an autoimmune disease of the central nervous system (which effects nerve impulses within the brain, spinal cord and optic nerves), and its unfortunately incurable. There are currently over 25,000 people living with this disease in Australia who, in the age of Covid, may often seek help and support online. There are some great support groups a...nd online communities out there! 22.01.2022 When talking to our clients, we often find there is often a significant delay between their injury/illness and their call to us to claim TPD. 21.01.2022 My TPD claim has been rejected, how can I challenge the insurers decision? It is not that uncommon for insurers to initially decline a claim, only to have it approved upon review. There are many reasons why this happens not meeting some of the requirements, incomplete medical documentation, etc. A good TPD lawyer can examine all aspects of your case and can request an internal review, report your case to the appropriate authority or commence your claim in court.... Case review processes can be quite complex and technical. Leave it with us - we think you have been through enough stress by now. Caring, compassionate and professional. 20.01.2022 TPD and brain injuries. "Brain injuries" is an umbrella term used to describe a range of different injuries. Those living with a brain injury usually suffer a greater decrease in their quality of life than the average for people living with a disability. Their ability to work, look after themselves and their family, and their financial security can all change dramatically. Fortunately, they may make a TPD Claim for a brain injury (provided they meet the eligibility requirem...ents) and receive some much-needed financial relief to help them through this process. 20.01.2022 Confused about all sorts of life insurance out there? Different life insurance can protect you from different events that can occur, but basically there are 4 major types: Total and Permanent disability (TPD) insurance - pays a lump sum if you become totally and permanently disabled because of illness or injury. ... Trauma Insurance - pays a lump sum amount if you suffer a critical illness or serious injury (excludes mental illness though). Income Protection Cover - pays up to 85% of your income for a specified time if you're unable to work due to partial or total disability. Life Cover - pays a lump sum amount of money when you die. 19.01.2022 Trade workers makes up 31% of Australias workforce but represent 58% of our accidents and serious injuries. While it may not be a huge surprise that a job involving physical exertion on a daily basis can lead to injury, this is a sobering and disproportionate statistic. 15.01.2022 Oftentimes a TPD claim comes down to proving your injury or illness meets your insurers definition of totally and permanently disabled. But what about those conditions that cant be proved easily, such as anxiety, depression, and stress? Proving these invisible illnesses is difficult enough, and in TPD claims insurers hold mental illness claimants to a higher standard of proof. This is because generally speaking, insurers are hesitant to approve a TPD claim for anxiety,... stress or depression. 14.01.2022 Q: I stopped work years ago due to illness. Can I still make a Super TPD claim after all this time? A: People usually dont make claim TPD claims for 2 reasons: they dont know they have TPD in their Super, or... they are too unwell to proceed at the time. To answer the question - yes, you should be able to make a claim as most Super funds have no time limit on when you are required to lodge the claim. You may however come across a few difficulties such as your medical records not being available any more, doctors retiring etc. So yes you could make a claim, but it generally gets a bit harder. If you think you have a TPD case you didnt claim, we are happy to review it and see what can be done! 1800 865 225 or https://wkblawyers.com.au/

09.01.2022 Generally speaking, if you sustain an injury or illness that prevents you from working, you will be able to claim under your TPD policy. 06.01.2022 5 things you probably dont know about TPD: 1. People often dont even know its included in their Super. 2. It covers a range of physical and mental illnesses and injuries. 3.
