After doing all the work with our unfair dismal case which was already drafted, paid for & submitted, Brian Newman coaxed (and I don’t use this word lightly) us into paying him $3850 for his services by introducing another matter (regarding mobile phone use) that he advised us he would introduce at conciliation and was confident he had a good case (proof available).. he stated words to the effect of... we have an excellent case and I’m confident in settling it at conciliation. We advised Brian more than once that we were confident in doing the conciliation ourselves and advised him in writing (proof available) that we had already completed the process and we would like to do the conciliation and would consider engaging him afterwards for the ‘other’ matter if we decided to proceed. We voiced our concern to him that we knew we were only entitled to $2000 and it was a risk to pay nearly double that amount ... to go after this new matter that ‘he introduced to us’.. however he insisted and advised us when voicing our concerns.. ‘As I mention previously, I think it's a great case’. We spoke to Brian on the phone.. no proof.. however we went from concern that we were paying nearly $4000 for an amount we knew we could recoup of $2000 and two days later paid the $3850. Those unrecorded conversations were Brian’s confidence and insistence that he had a good case and would introduce the new matter at conciliation and confident he could settle at conciliation. Why else would we pay nearly $4000 when we were only entitled to $2000 for the unfair dismissal? This is when we trusted Brian and foolishly believed he knew what he was doing and paid him the $3850. At conciliation Brian was shut down IMMEDIATELY by the conciliator who reminded him, that he KNEW he was not allowed to introduce a new matter at conciliation (proof of this). How could an experience workers first and human rights advocator not know that he could NOT introduce a new matter at conciliation? How could this advocator lead us to believe he could? This experience workers & human rights advocator also proudly advised us he wins over 90% settlement at conciliation?. We are now out of pocket for $4000 after repeatedly voicing our concerns about going after this ‘new mobile phone matter’ and informing Brian we were confident to continue with conciliation ourselves. After being shut down immediately for introducing a new matter that the conciliator advised him ‘he knew he couldn’t’, Brian advised us that he had a plan and said words to the effect of ‘I hadn’t done much towards the conciliation so you won’t have to pay more’ he has then fallen silent, not answering texts or phone calls and emailing messages that he was caught up in a ‘catastrophic matter’ (email evidence). Brians lack of experience at the conciliation and his behaviour following was a disgrace and lacked integrity. -With all this experience how could he not know he couldn’t introduce a new matter at conciliation? -Why were we led to believe he could introduce this matter and was confident he could settle it at the meeting? -How could he walk away with our money when he didn’t do the preparation for the conciliation or do what he said he ‘believed’ he could do.. and then fail? Yes, he did throw out there that he can’t ‘guarantee’ a win, but this was buried under the continuous confidence that he could bring this new matter to settlement and was asking for 12 weeks pay... to lock us in. At the time we paid this $4000 to Brian, we were two days out from the conciliation meeting we were prepared to do and were booked in to do. Again, why would we have paid the money? Even though we had already drafted, paid and submitted the form for conciliation, and Brian knowing he wrongly informed us he could introduce this new matter (according to the conciliator, he ‘knew’ he couldn’t), still refused to consider refunding us any of the money paid in good faith to him for the ‘new matter’. This is, in our opinion, not a man of integrity, that we would ever recommend.l, and if he threatens to sue us like he has with other unsatisfied clients... we welcome it as an opportunity to present our case and the facts.
