08.01.2022 LANDMARK DECISION BY THE HIGH COURT The Federal Court decision in the Mondelez Australia Pty Ltd v AMWU & Ors case. which resulted in the calculation of personal leave to be the hours the employee works in a shift, has today been overturned by the High Court of Australia. The High Court stated that "The expression '10 days' in s 96(1) of the Fair Work Act 2009 (Cth) means 1/26 of the employee's ordinary hours of work in the year of service with their employer meaning Employ...ers will not be required to give employees that work their ordinary hours over less shifts in a week more personal leave hours than those employees that work the typical 5 day week. Fairness in this decision is that employees that work the same average of hours in different shift patterns in a week will accrue the same personal leave balance a year. #personalleave #accrual #highcourtdecision #employmentlaw #workplacehq Peoplefusion - Osborn Law - Skildare
