25.01.2022 Now this is worth a read: Judges criticised for ‘outrageous leniency’ on serious drink driving offenders. A judge has been slammed for ‘outrageous’ leniency after slashing prison terms for high-range drink drivers one of whom crashed his car after drinking a bottle of scotch and quashing the conviction of a woman guilty of mid-range DUI. ... 25.01.2022 POLICE have warned motorists they are blitzing SCHOOL ZONE CROSSINGS and have asked residents which schools they should target. On its Facebook page, the Northe...rn Beaches Police Area Command invited people to nominate schools you’d like us to visit. Based on the replies, motorists, as well as mums and dads dropping off and picking up children, are doing the wrong things right across the peninsula. Maria Regina Catholic Primary School in Central Rd, Avalon, was mentioned because every school morning just watch them fly past the school and then through the red light onto Barrenjoey Rd. A parent asked police to patrol Emma St, at school pick up time for Mona Vale Public. The same cars are continually parked in the No Stopping zones, meaning cars have to go onto the wrong side of the road to get past. It’s so dangerous and will result in a head on!!!. At Collaroy Plateau Public School a local said that at the entrance on Hilma St I see some mums do the most stupid, dangerous, illegal things. A resident said that on nearby Rose Ave, outside St Rose Catholic Primary School cars are so banked up behind the pick up zone that frustrated drivers overtake on the other side of the road. Bad accidents waiting to happen. Between 6am and 10am Rabbett St, Frenchs Forest, is a bus-only route where it meets Forest Way. But one resident was upset that impatient car, taxi, truck, bin lorry drivers are all driving like idiots where it’s dangerously overcrowded with school kids arriving and departing on the buses. A frustrated parent wrote: PLEASE PLEASE PLEASE patrol Maretimo St, Balgowlah, outside Bally Boys (Balgowlah Boys High). Not only is there no school crossing, cars completely ignore the 50kmh school zone. Kids are darting out from behind school buses and will be hit by speeding drivers. In Ann St, outside Frenchs Forest Public, a resident has seen kids halfway across the crossing and people drive straight through without looking. At Newport Public School in Beaconsfield St, a resident pointed out that at pick up time heaps of people think it’s okay to park for longer than 2 minutes providing they are sitting in the driver’s seat and on their phone. Crossings at Harbord Public School on Oliver St also got a mention as did McIntosh St outside Narraweena Public and nearby Alfred St outside St John’s Catholic Primary School. Police were also invited to turn up outside Wakehurst Public School and North Curl Curl Public School. https://www.dailytelegraph.com.au//9315c561cb7feb915ffde38

23.01.2022 High Court rules sperm donor is daughter's biological father, stopping her moving overseas with mother By Elizabeth Byrne Updated 14 minutes ago The court heard the man played an active role in the girl's upbringing, and she knew him as "daddy". (Pexels)... RELATED STORY: Sperm donor seeking to be named girl's legal father to keep her in Australia. A man who donated his sperm to a friend with the belief he could play a role in the child's life has won a High Court fight sparked by the mother's decision to move to New Zealand with their biological child. The court was told the man was listed as the girl's father on her birth certificate, and that she and her sister, to whom he was not related, called him "daddy". The man, given the pseudonym Robert, had been friends with the girl's mother, and the two had agreed that he would provide his sperm so she could conceive. She later married a same-sex partner and they decided to move to New Zealand, triggering Robert's legal move to keep the girl in the country. The main issue before the High Court was whether Robert was legally the girl's father, or whether his role was limited to biology. The girl's mother and her wife argued the man was not her legal father, citing a New South Wales law setting out rules for fertilisation procedures, which specifically addressed the situation of same-sex couples. But today the court ruled in the man's favour, overturning a previous appeal the girl's mothers won and reinstating a Family Court judgement that ordered the women to live in Australia. The reinstated ruling also requires the women to consult with Robert about long-term parenting decisions.

22.01.2022 Please contact BTF Lawyers if you realise that you need to draft or update your Will. Given the current circumstances it is unlikely you will be able to have two independent witnesses, to witness your signature. However, you can still sign and date your Will. BTF Lawyers can offer you the means by which you can undergo your verification of identity (VOI), online. The VOI document, may assist in the proof required to show that the Will created was made during the limitations o...f the current crisis. Although this will not replace a Will that was executed in accordance with the prescribed legislation, the courts may admit an informal Will to Probate provided that: 1. It is ‘a document’; 2. The document sets out the author’s wishes or intentions for what he/she wants to happen in the event of his/her demise; and, 3. The Court is satisfied that the Will-maker intended the document to operate as his/her Will. It is always recommended that you have your Will professionally prepared. At BTF Lawyers we will also ensure that specific wording is inscribed into the document noting the current prevailing crisis. See more

10.01.2022 Never say never. Solicitors and executors need to be VERY careful when handling deceased estates when there appears to be no will. Such is the case in a matter ancillary to one that I am handling. The will turns up well after distribution of funds. Assuming the will is valid, the grant will need to be revoked so that the executors can obtain a Grant of Probate and administer the estate according to the will.

09.01.2022 No conviction for drink-driver Greg Inglis Luke Costin, Australian Associated Press January 14, 2019 2:35pm NRL star Greg Inglis has escaped conviction and been placed on a good behaviour bond for his "very poor decision" to drink and drive.... The South Sydney Rabbitohs captain on Monday was handed an 18-month good behaviour bond for having a blood alcohol of 0.085 on October 1 last year when he was caught speeding at 99km/h in an 80 zone on the outskirts of Lithgow. Downing Centre Local Court was told Australian Kangaroos coach Mal Meninga and NRL chief executive Todd Greenberg were among those who'd written character references for the father of two and long-time rugby league star. NSW chief magistrate Graeme Henson when sentencing Inglis considered his remorse, lack of criminal record, guilty plea, substantial charity work and the media attention surrounding the case. He also noted the incident led to Inglis being banned from driving and stripped of the captaincy of the national men's rugby league team - an honour only bestowed on an indigenous man once before. Inglis, who turns 32 on Tuesday, said he was grateful after avoiding a conviction. "It was a very poor decision on my behalf," the father of two told reporters. "I'm very sorry and remorseful for what happened. I try to be a positive role model in the community and around the club and around Australia itself. "(My focus now is) getting back into training now and being (a) positive role model." The court heard Inglis didn't know how much he drank while celebrating the end of the Koori Knockout tournament in Dubbo on September 30. But he headed to bed about midnight and waited until 11am to drive back to Sydney. He had a schooner at lunch in Lithgow minutes before he was stopped by police. "It must have been quite a heavy night before," Judge Henson said. "I accept you did your best at that time. None of us are perfect as much as we try." But the chief magistrate lectured the NRL star on the risk drink drivers pose to the community. "Driving at speed while drink driving makes you something like three or four times more likely to crash," he told Inglis. "There is only one safe approach - drink and don't drive or drive and don't drink." Inglis's lawyer, James Jordan, noted the NRL star completed his traffic offenders program with the general public despite being offered private sessions which would have allowed him to avoid further scrutiny.
