22.01.2022 Effective from 11th of June 2019, AUSTRAC has changed the process of authorising external auditors under subsection 164(1) of the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act). Accordingly, AUSTRAC has revoked existing authorisation of all external auditors currently authorised pursuant to s164 of the AML/CTF Act and removed the List of Authorised External Auditors from the AUSTRAC website. AUSTRACs website states, in future, authorisation ...is to be undertaken by AUSTRAC on an as needs basis and only when AUSTRAC requires a reporting entity to appoint an external auditor. AUSTRAC can authorise an individual to be an external auditor for the purposes of the AML/CTF Act and require a reporting entity to appoint an external auditor. Authorisation process The reporting entity must provide AUSTRAC the following documents about the proposed external auditor/s: 1. a capability statement, which will demonstrate whether the applicant possesses the relevant qualifications, experience and skills; and 2. a signed Statutory Declaration to outline the character of the individual, declaring that the applicant will inform the AUSTRAC CEO as soon as practicable but no later than seven days after becoming aware of any conflict of interest that may arise; and 3. a resume which provides an overview of the individuals employment and education history, and any other information the individual considers is relevant to their application.
