14.01.2022 Wednesday morning 6am, who's with me??

06.01.2022 We would like to thank the many people who yesterday made us aware of a post that was made by another Registration Company, in which they claimed that registrat...ion with them was not only a requirement for you to work, but in which they also tried to coerce people into registering with them by offering to honour any time remaining on registration with other companies. We think that this post was extremely shameful, misleading and blatant false advertising. We would like to remind everyone that the particular company who made this post is not a Government Body of any kind, but a private company and registration with them is in no way a legal requirement. We also wish to remind everyone that under the Fair Work Act 2009, you have Freedom of Association, which gives employees (or sub-contractors) in Australia the right to choose any industry association that they wish to be registered with. Under Section 32 of The Fair Work Act, if an employer were to make registration with one specific organisation a condition of employment, this would be discrimination based on terms of employment and is essentially unlawful. If an employer insists that you be registered with one specific organisation over another, then they would be responsible for covering the costs associated with that. To be extremely clear, a workplace CAN NOT tell you to register with one specific organisation over another and expect you to cover the costs out of your own pocket, nor can they tell you that they "do not accept" registration with any specific organisation or make registration with one specific company a condition of employment in your contract (they would need to cover the costs). For an organisation to claim that registration with them specifically is a requirement for you to work as a Fitness Professional in Australia is outright false advertising. There are several organisations within Australia that provide professional industry registration for Fitness Professionals, including but not limited to: The Health and Fitness Association of Australia FITREC Physical Activity Australia ESSA Fitness Australia Yoga Alliance Australia (yoga instructors only) Pilates Alliance Australasia (pilates instructors only) We encourage all Fitness Professionals to research their options and make their own choice based on what is best for them. The Fair Work Act is available for you to read here, with specific reference to points 342, 347, 349: https://www.legislation.gov.au/Details/C2017C00323 You can also phone Fair Work directly on 13 13 94 or make an online enquiry if you are seeking further clarification or wish to query this information (we did!). If you are experiencing these types of requests in your workplace we encourage you to speak with your employer to clarify any misunderstanding there might be surrounding this. If you are experiencing unfair treatment, you can also make a complaint directly to Fair Work here: https://www.fairwork.gov.au/ You can also contact the Union for assistance with any such matters here: https://www.unitedworkers.org.au/ (not a Union member? you can join for FREE here www.healthandfitness.org.au/union) Enquiries/complaints regarding organisations who claim that you MUST be registered with them to work can be sent here: https://www.accc.gov.au//contact-t/report-a-consumer-issue
