10.01.2022 ***BREAKING NEWS*** Jo Cooper has won her appeal. In a unanimous decision, the NSW Court of Appeal has found that the by-law banning pets in her #strata building is invalid because it is "oppressive".... It is oppressive because "it prohibits an ordinary incident of the ownership of real property, namely, keeping a pet animal, and provides no material benefit to other occupiers." 07.01.2022 ** Important new strata decision*** NCAT's Administrative and Equal Opportunity Division has today confirmed that owners corporations DO provide "services" and are therefore caught by disability discrimination legislation. ... In Araya v Owners Corporation SP65717 [2021] NSWCATAD 5, the Tribunal considered whether an owners corporation discriminated against a disabled resident and her husband by enforcing a by-law prohibiting parking in a visitor parking space marked disabled. It was alleged the owners corporation did not enforce the by-law against other residents parking in that space. Whilst the Tribunal found that the residents in this particular case had not made out a case for discrimination, it referred to earlier case law and confirmed that disability discrimination legislation does indeed apply to NSW owners corporations.
