24.01.2022 As a bankruptcy trustee I am seeing more and more SMSF interactions with bankruptcy. This article provides a good general explanation of the impact of bankruptcy on an individual who has an SMSF - albeit that I believe the 6 month grace period starts from the date of bankruptcy, as opposed to the notice of resignation discussed in the article, also consider that Section 116(2) of the Bankruptcy Act only affords protection for superannuation monies to the extent that the fund is complying. This begs the question what is the SMSF is non-complying - is it fair game!!
