11.01.2022 SPIN, SPIN and MORE SPIN Territorians will not be hoodwinked, by half-truths, and selective information. We know when we are being failed. This media release ...from the Territory Government is nothing but spin. The Territory Government needs to admit that it has failed to secure the best outcomes in the interests of all Territorians, especially recreational fishers and the Traditional Owners of Sea Country. The Registration announced by the NLC today is a permit in all but name. Yet this is far from the most important issue, after all it is up to Traditional Owners if they want permits or not. The biggest issues here are that today, for the first time in 12 years since the Blue Mud Bay Decision, areas where Traditional Owners have continuously decided to share their waters with all Territorians are now closed and off limits to recreational fishers. Incredibly, this comes only months after the 2020 election, before which Territorians were told that a $10M deal had been signed to ensure certainty of access and progress in resolving BMB. The simple Blue Mud Bay Registration permit is being touted as a solution, but the Government is publicly ignoring what it knows behind the scenes; The registration does not cover access to any areas within 200km of Darwin. And most areas that are covered would be accessible anyway, or will require additional permits to get to. The only part of the Finniss River open to recreational fishing is the first 5km, which is not Aboriginal Land. The Fog Bay coastal creeks, including the Little Finniss River are now off-limits to recreational fishers, with or without a permit. Meanwhile the Government release is celebrating the fact that Dundee Beach (which is not Aboriginal Land) remains permit free. The Mini Mini region is also now closed to recreational fishers with or without a permit. Most areas that are covered by the free registration permit require long journeys along the coast, or will require additional permits to enter Aboriginal Land, which we were advised last week are not being issued due to COVID. The areas that are covered can change at any time, there is no certainty. In the press release issued today, the NT Government lists a range of other locations where permit-free fishing can occur. Many of these areas are not even Aboriginal Land. Yet the Government says this is other good news. The fact is certainty of access has gone seriously backwards since the 2020 election deal (The Implementation Action Plan) was signed. AFANT thanks the many Traditional Owners who have been sharing their waters with fishers for years, especially those who have waited so long and seen nothing in return. AFANT fully respects that Traditional Owners are the sole decision makers for what occurs on their lands and waters, Yet, it must be acknowledged that the Northern Territory Government plays a huge role in what options are put on the table. Only the Territory Government can provide the funds, framework and leadership needed. The Government needs to act. It needs to govern for all Territorians, by reviewing the agreements on offer for permit free access and working on new agreements to underpin certainty of access for areas where Traditional Owners have made it clear they will require people to have a permit or registration. On Friday, the NLC told AFANT’s CEO that Traditional Owners for the lower Finniss River had decided to close their section of the river because they did not want to commit to another two years of access in return for nothing. Traditional Owners should not have to wait up to two years for long term access agreements that can provide benefit. Yet this is what is outlined in the Action Plan, and what was reiterated in the Government media release today. The Territory Government cannot continue to hide behind the Action Plan deal or the NLC. It must take a proactive interest in securing certainty of access, as it has promised. It must put its best offers forward for Traditional Owners so that they can benefit immediately, whether offering free permits, or permit-free access to fishers. This is also the only way to ensure certainty for recreational fishers and all the businesses and jobs that rely upon them. It is time for the Government to level with Territorians, to go over and above the Action Plan and to implement actions that achieve the best outcomes possible for all involved, immediately.
