25.01.2022 South Australia invitation news for subclass 190 and 491 - Skilled migration The states allocation of interim 491 and 190 visa nominations are intended to support and prioritise South Australias economic recovery and public health response. Prospective applicants will be able to lodge an Expression of Interest (EOI) through the Department of Home Affairs SkillSelect system. An invitation to submit an online application for state-nomination will be sent to prospective applicants with EOIs that meet Commonwealth and South Australian priorities. The Government of South Australia will publish state nomination requirements on 27 August 2020. From 31 August, South Australia will commence reviewing EOIs and sending invitations to submit an online application.

We will continue to accept online Skills Assessment applications; however, we will not be able to respond to any emails and phone calls during this time. Priority Processing applications on hold... Our Priority Processing service for general professional occupations will be suspended during the shutdown period. 14.01.2022 New Financial Year Updates Status of all state nomination authorities at the start of new Financial Year. The State & Territory nomination program will remain temporarily closed until the Commonwealth Government's allocation of state nomination places for 2020-21 takes place. This means that State & Territory governments have no ability to nominate applicants in visa subclass 190 & visa subclass 491.... The GSM 2020/21 program year is scheduled to re-open from early August however, changes to the composition of the Australian Migration program might be made in October under the new budget. Due to the Coronavirus, the date for Federal Budget 2020-2021 has been delayed by the Federal Government - it will be handed down in Parliament on 6 October. The Federal Treasurer has advised that he will provide an update on the economic and fiscal outlook on 23 July. Here is the detailed status of all the states based on the updates published today: NT: Currently open. We are assuming that no nominations will be issued until the grant of new quota. New eligibility criteria in place for all applicants. Closed for offshore applicants. WA: Currently open. No updates yet from state authority. 13.01.2022 So many people ask if it is necessary to full fill your state obligations if nominated by a state for a 190 or 491 - well please all take note with what ACT is doing, all other states will follow suit- Canberra Skills Integrity check ACT Residence sc 190 and sc 491 Canberra is conducting an integrity check of continued ACT residence for those who have been nominated for a subclass 190 visa by the ACT government.... ACT 190 nominees are required to provide bank statements as evidence of their continuing ACT residence. If Skills Canberra is not satisfied that the ACT nominees are currently resident in Canberra, their ACT 190 nomination may be withdrawn. If ACT 190 nomination is withdrawn, the Department is unable to grant the visa. Further, it appears that an integrity check of continued ACT residence for ACT sc 491 nominees will commence shortly.

The Australian Government allows both Registered Migration Agents and lawyers to assist people with their migration issues. Lawyers are usually more expensive than migration agents. Migration agents focus on one thing: assisting people with migration law. Some lawyers are specialists in migration law, but may also practice in other areas such a...s family law, criminal law, or property law. Lawyers and Registered Migration Agents are both highly educated. Lawyers must do an undergraduate degree and then gain professional training. Registered Migration Agents must have an undergraduate degree plus a Postgraduate Diploma in Migration Law, plus undergo professional training. Both a Registered Migration Agent or a lawyer are qualified to take your appeal to the Administrative Appeals Tribunal (AAT). Only a lawyer can take your matter to the Federal Court. Taking an appeal to the Federal Court (or Federal Circuit Court) is a big decision. You would normally only do this if you had lost at the AAT and you want to appeal on a point of law. For this you need a good lawyer who knows this area very well. It can be very expensive and very high risk since, if you lose, you may have to pay your own lawyer but also the lawyers employed by the Government. For most people needing assistance with their visa application or refusal, a Registered Migration Agent provides a high level of knowledge and professional skill, at a more economical price. 07.01.2022 Govt Announces VAC Changes and Waivers/Refund Details Hi all - further details from the government released this morning: Visitors Visitor visa holders who are overseas and whose visas expired or will expire between March 2020 and December 2021 will be eligible for a waiver when they apply for a new visa. Working holiday makers... Backpackers on Working Holiday Maker visas who have been unable to come to Australia or who had to leave Australia early due to COVID-19 will also be eligible for a waiver, when they decide to return to Australia. Those who are unable to return because they have passed the age limit for a Working Holiday Maker visa will be able to claim a refund. Seasonal Worker Program and Pacific Labour Scheme workers Seasonal Worker Program and Pacific Labour Scheme visa holders will also be eligible for a refund of the VAC if they were granted a visa before 20 March 2020 and have been unable to travel to Australia due to COVID19 Temporary skilled workers Due to travel restrictions there are many Temporary Skill Shortage and Temporary Work (Skilled) visa holders who have not made their initial entry to Australia, or have returned home due to COVID-19 and may wish to apply again. To support local businesses that seek to access critical skills not available in the local labour workforce, the Government will offer a waiver of the VAC for subsequent applications by affected temporary employer sponsored skilled migrants. Prospective Marriage visa holders The Prospective Marriage visa provides holders with nine months to travel to Australia to marry an Australian citizen or permanent resident. VAC refunds will be available for Prospective Marriage visa holders who have been unable to enter Australia before their visa expired, due to COVID-19 related travel restrictions. Refunds will ensure these visa holders are able to apply for another visa to travel to Australia and hold their wedding once travel restrictions are lifted. 06.01.2022 2019-20 Migration Program Outcomes The Government has published the detailed outcomes from the 2019-20 Migration Program. South Africa came 9th in the list of source countries for visas with 3,743 visa places. They have also confirmed that the size and composition of the 2020-21 Migration and Humanitarian programs will be considered in light of the developing COVID-19 situation and announced as part of the Budget process in October.... Skilled Stream The Skill stream outcome was 95,843 places, which accounted for 69.5 per cent of the total 201920 Migration Program outcome (excluding Child stream). Within the Skill stream: - The Employer Sponsored category had an outcome of 29,261 places against a planning level of 30,000 places. Employer Sponsored visas comprised 30.5 per cent of the Skill stream outcome in 201920; - The Skilled Independent category had an outcome of 12,986 places (13.5 per cent); - The Regional category delivered 23,372 places against a planning level of 25,000 (24.4 per cent of Skill outcome). Of this, 15,000 places were delivered in Skilled Work Regional and 8,372 places in Skilled Employer Sponsored Regional; - The State/Territory Nominated category delivered 21,495 places (22.4 per cent); - The Business Innovation and Investment Program (BIIP) had an outcome of 4,420 places (4.6 per cent); - The Global Talent category, which was launched on 4 November 2019, delivered 4,109 places against a planning level of 5,000 places; and The Distinguished Talent category had an outcome of 200 places (0.2 per cent). https://www.homeaffairs.gov.au//report-migration-program-2
