24.01.2022 Did you know that in QLD when you purchase a property, the property is at your risk from 5:00pm on the first business day after the Contract Date. Despite this, the Seller has an obligation until settlement to take reasonable care of the Property. However, if the Property is damaged between the Contract Date and settlement (e.g. fire or vandalism) you are still required to settle in accordance with the Contract (unless it is so destroyed or damaged as to be unfit for occupa...tion). 16.01.2022 Stamp duty can sometimes be complex and we understand that it can be confusing to know whether a concession is available or if an exemption may apply. At MKP Property Lawyers, we have a team of dedicated property lawyers who are always up to date on the latest public rulings relating to stamp duty. In the past year we have observed a significant change in how stamp duty is applied to foreign investors, on or after 1 July 2018 a 7% Australian foreign acquirers duty (AFAD)... is applied to the foreign acquirer's interest of the dutiable value of the AFAD residential land. However, where the transaction's liability for transfer duty arises between 1 October 2016 and 30 June 2018, the AFAD remains at 3%. As a foreign acquirer, you can still claim the first home concession, first home vacant land concession and home concession if you meet the relevant requirements. But the concession will only apply to the calculation of transfer duty - you will still need to pay the AFAD calculated on the dutiable value of the AFAD residential land. If your relevant transaction is exempt from transfer duty, landholder duty or corporate trustee duty, it will also be exempt from AFAD. 11.01.2022 Limited recourse borrowing arrangement's (LRBA), is an arrangement that permits a superannuation fund to borrow money from a lender to purchase property, under strict conditions. As per the diagram above, the Self-Managed Super Fund (SMSF) trustee borrows from a lender to purchase a property, and the SMSF trustee then has an agreement with a holding or bare trustee which outlines that the holding/bare trustee will hold the property on behalf of the super fund. Then, the ...holding/bare trustee may enter into a contract to purchase property from a vendor using money that was loaned to the SMSF trustee. 09.01.2022 ALERT - QUEENSLAND PROPERTY OWNERS! The way in which the Queensland Titles Registry deals with paper certificates of title (paper CTs) is changing. Due to a recent Bill being passed in Parliament, as of 1 October 2019, paper CTs will no longer have any legal effect. ... This change means that as of 1 October 2019, the 11% of paper CTs that still exist, will become an item of historic or sentimental value only and will no longer need to be deposited with the Titles Registry when a transaction is lodged over the title. The electronic title held in the Titles Registry will continue to be the point of truth for ownership and other interests in land in Queensland, and will be the only point of truth for ownership from 1 October 2019.
