19.01.2022 INCREDIBLE RESULT Client was charged with Supply Prohibited Drug greater than a Large Commercial Quantity (260kgs of Methylamphetamine commonly known as ‘Ice’) The client received 6.5 years with a Non-Parole Period of 4 years, meaning that after 4 years, he is eligible for release on parole.... Why did he get this result despite the insane amount of drugs he was carrying? Through the thorough preparation of our lawyers and the skill of Senior Counsel Phillip Boulten, we were able to successfully argue that the client’s role in supplying the drugs was more important than the weight of the drugs involved and that his sentence should reflect that. It was agreed he was only the driver of the drugs for a short amount of time and there was no evidence he had any involvement beyond that. He was not a member of a criminal group and was not responsible for sourcing, financing or involved in the planning of the delivery of the drugs. He didn’t know exactly what he was carrying or how much he was carrying. He was not responsible for managing others or acting as a middleman. He had no decision-making power but acted on instructions, being told where to go and what to do. He did not involve himself for pure profit but accepted the job because he was vulnerable, being under financial pressure and suffering from a number of addictions. The client demonstrated remorse and good prospects of rehabilitation. Through meticulous research, we were able to demonstrate that offenders sentenced for importing amounts of drugs similar to the client who had similar roles received similar sentences. Importantly, the client exercised his right to silence from the moment he was arrested and did not incriminate himself further, enabling us to put forward these arguments on his behalf.
