25.01.2022 The Department of Immigration & Border Protection is introducing new regulations to enhance visa integrity and clearly communicate what is expected from non-citizens during their stay in Australia: Changes for Temporary Visas Individuals who apply for, and are subsequently granted, a temporary visa on or after 18 November 2017 will be subject to new conditions during their stay in Australia:... Visa condition 8303 will prohibit activities that endanger or threaten any individual, or activities disruptive to, or violence threatening harm to, the Australian community or a group within the Australian community. Visa condition 8304 will require temporary visa holders to identify themselves by the same name in all dealings with Commonwealth, state or territory government agencies. If you change your name, you must inform all government agencies of this name change, including the Department of Immigration and Border Protection, as soon as possible. Visa condition 8564 will require individuals not to engage in criminal conduct. Individuals who are subject to this condition, and who receive a criminal conviction during their stay in Australia, may have their visa cancelled. Changes for all visas Regulations are also being tightened with respect to all visa applications to improve overall visa integrity: Public Interest Criterion 4020 has been strengthened by increasing the period in which previous instances of fraud (this also includes not informing the Department if you have any convictions whatsoever) can be considered from 12 months to 10 years, for any visa applied for on or after 18 November 2017. Permanent Humanitarian and Protection visa applications are not affected by this change. Permanent visa holders who are being considered for cancellation of their visa will not be eligible to apply for a resident return visa (RRV) on or after 18 November 2017. Bridging Visa E (BVE) application criteria have been amended to prevent an application from a person whose last visa was cancelled due to a breach of conditions 8303 or 8564, or because they were deemed a risk to the community. The Department can still grant a BVE to such individuals without application where appropriate.



24.01.2022 New limitations on sponsorship's for Partner and Prospective Marriage visa applications are being introduced on 19th November to help stop domestic violence. Sponsors of Partner and Prospective Marriage visa applicants who lodge a visa application, on or after 18 November 2016, will be required to: provide Australian or foreign police checks to the department when requested; and consent to the department disclosing their convictions for relevant offences to the visa appl...icant(s). Relevant offences include violence against a person, people trafficking, and having weapons, to name just a few. If a sponsor has convictions for a relevant offence AND a significant criminal record, the visa is very likely to be refused. A significant criminal record includes where the sponsor has been sentenced to: death; imprisonment for life; a term of imprisonment of 12 months or more; 2 or more terms of imprisonment, where the total of those terms is 12 months or more. So be warned - there is no wriggle room or place for domestic violence in our society.

23.01.2022 From 1 July 2017 Family Visa (partner visa) Sponsors will need to lodge and have approved a Sponsorship Application, before the actual partner visa Application can be lodged. This could have a massive affect on all of those applications where the visa is expiring shortly. This sponsorship application presumably wont be without any cost when introduced. 22.01.2022 Visa and citizenship processing times worldwide will be available online for the first time from 14 March. Yayyy! These will give you a better idea of how long it is taking to process a particular visa subclass, stream, or citizenship applicatio and replaces the current 'service standards' which are really out of date. This is part of the Departments ongoing efforts to improve client information, and will give you more meaningful data about the visa or citizenship product ...of your choice. Processing times will be updated monthly to reflect current caseloads and processing pressures, and will be available for most visa subclasses and citizenship application types. It won't include processing times for some subclasses, as they are closed to new entrants, or capped and queued, e.g. some parent visas.

18.01.2022 Australian citizenship law changes mean migrants will face tougher tests! The Federal Government has announced sweeping changes to the nation's citizenship laws, with the Prime Minister Malcolm Turnbull declaring that new arrivals must prize "Australian values" and prove their commitment to the nation. Key points: Migrants with a history of family violence, organised crime could be banned... English language test will contain more components Permanent residents' eligibility for citizenship application will increase to four years Migrants will face a tougher citizenship test which will assess their commitment to Australia and their attitudes to religious freedom and gender equality. Those with a history of family violence or organised crime could also be barred from citizenship. Applicants will be asked to demonstrate that they have integrated into Australian society, for example by joining clubs or by providing evidence that they are employed and their children are in school. A more stringent English language test will also be introduce, which will include "reading, writing and listening" components. Migrants who become permanent residents will also have to wait four years before they can apply for citizenship instead of the one-year wait they face at the moment. If an applicant fails the test three times they will have to wait another two years before they can sit it again. To read more click on the link below

15.01.2022 Great news for everyone applying for partner visas! Ealier this year DIBP announced that major changes were coming to partner visa's in July. The only information that we were able to obtain was that the sponsor would have to lodge their part of the application first and have it approved prior to the applicant lodging their application. As no information had been provided in regards to the length of time it would take for this to happen it left many, many couples dashing to ...lodge their applications prior to this change. Yesterday DIBP announced that the Migration Amendment (Family Violence & Other Measures) Bill had not yet been enacted as it is still before the Senate and will not be commencing on July 1st 2017 but has been deferred until 2018.

13.01.2022 Citizenship Update! Following the removal of the Australian Citizenship Legislation Amendment (Strengthening the Requirements for Australian Citizenship and Other Measures) Bill 2017 from Government business, the Department has updated the information on its website. The government still propose to go ahead with plans to reintroduce an amended version of the Bill, with a proposed introduction date of 1 July 2018. The English language test will be amended to a 'modest' level ...of English. Applications made before 1 July 2018 will be assessed against the eligibility criteria current at the time of application. Changes to the criteria will take effect from 1 July 2018, if the legislation is successfully passed. What does this all mean? It means you only have to have permanent residency for one year, not four as per the proposal. You still need to ensure that you meet all criteria at the time of your application.

13.01.2022 More changes to visas If you are applying for an Australian visa and want to bring dependent family members with you, there are some changes you need to be aware of. The two key differences from current arrangements are: 1) only partners and children can meet the definition... (other relatives such as dependent parents, are no longer permitted); 2) children are limited to individuals aged: - under 18; or - between 18 and 23 only if they are dependent (an upper age limit has been added); or - 23 or older only if they are physically or mentally incapacitated for work. These new arrangements will impact all applications lodged on or after 19 November 2016

11.01.2022 For those of you who didn't see my earlier post on 14 March, the Dept of Immigration has changed to a Global Visa Processing System (so they're sharing the processing of all visa applications to offices world wide). This means, for example, partner visa application processing times have really blown out. - Prospective marriage visas (subclass 300) have gone from 5-12 months to 12-17 months;... - Onshore partner visa applications have gone from around 12-16 months to being 18-20 months. - And NZ Family Visas subclass 461 from around 3-6 months to being 8-11 months. Dreadful.

08.01.2022 Damaged passports may be impounded and the holders may be detained in the wake of airport security escalation. Essentially any damage on travel documents that result in machine-reading failure or affect critical identity information can result in the document being impounded and that the traveller being detained or prevented from travel, according to the Standard Operating Procedure manual (SOP) of the Australian Border Force. Under legislation, it is a serious offence to use... or facilitate the use of a cancelled or otherwise invalid Australian travel document. The SOP which was released on an FOI request states that, suspicious, cancelled or invalid travel documents and travel documents where the holder has a financial debt to the Department of Foreign Affairs and Trade (DFAT) which are presented at the border should be impounded by a delegated officer. While the SOP notes that immigration officers have an over-riding obligation to facilitate the entry and departure of Australian citizens in a timely manner, they are however required to impound travel documents which they determine are not usable as evidence of identity and citizenship of its holder or to facilitate international travel. According to the SOP, the following points are evidence that a document is damaged and must be surrendered: any of the visible information (including the photograph or machine readable zone) on the data page of the passport has been altered or tampered with, is faulty or cannot be read reliably; the data page (including the laminate) of the passport has been tampered with, altered, damaged or dislodged, or has degraded, any page is missing, substantially damaged or damaged to the extent that it cannot be read reliably, any other part of the binding or the structure of the passport has been tampered with or substantially damaged, that any part of the passport's contactless integrated circuit (i.e. the electronic chip) is damaged or has been tampered or interfered with, or removed, other circumstances that the Minister could consider that make the document unusable as evidence of the identity and citizenship of its holder. The SOP notes that such damaged, invalid or suspicious documents will be impounded regardless of the holder's travel plans noting that there are potential adverse consequences for the holder if they are allowed to depart Australia on a damaged travel document as the document may be considered by foreign government border officials to be fraudulent. This may result in delays on arrival to, denial of entry into, and/or detention in other countries. Security at international airports particularly in Europe have been increased in the wake of terrorist attacks in Brussels which injured hundreds and killed at least 31 people yesterday. Prime Minister Malcolm Turnbull today called on Australian border force and airport security workers to cease strike action in the wake of the Brussels attacks.

08.01.2022 NEW 457 VISA HOLDER - CHANGES FOR ANYONE GOING ONTO A 457 VISA - THIS CHANGE AFFECTS YOU! For those people granted a 457 visa on or after 19 November 2016: If you leave your employer, you need to be aware that the time you can remain in Australia after ceasing employment with them is being reduced from 90 days to 60 days... If you haven't found a new employer to sponsor you within 60 days of ceasing your employment, you will be in breach of your visa condition 8107 and your visa may be cancelled.

08.01.2022 Bad news for Perth now that Labour has been elected. The 187 Regional Certification Board has been shut down and is no longer accepting nominations for WA as being regional. They are removing Perth from the Regional Sponsored Migration Scheme subclasss 187 visa. The WA skilled occupation list is under review. Who know what will happen now...uncertain times for skilled sponsored migrants.

07.01.2022 Heads up for all migrants! The ACCC is warning migrants of scammers pretending to be from government agencies including the Department Foreign Affairs and Trade (DFAT) in a new scam targeting recent travellers. The scam is targeting migrants, by calling them and claiming to be from DFAT and the DIBP alleging that they have given false information on their visa documents or departure documents when they returned home to Australia. The victim is told to either turn themselves o...ver to the police, pay approximately $1,000 via wire transfer through Western Union to stay in Australia, or face deportation. Scammers have obtained some victims personal information including date of birth and passport details and seems legitimate because the number that appears as the caller ID is the DFAT phone number. Please never give out your personal information unless you are sure that you're are speaking with the correct source. Also, government departments will never ask for a wire transfer as a payment option.

05.01.2022 If you are in the process of trying to lodge your own visa - or if you have an agent trying to lodge your visa today....forget it! The DIBP website is down apparently with massive technical issues. FYI please never leave the lodgement of your new visa application until the last minute because this sort of technical error will really mess you about and you could end up with your visa being refused if you don't know how to deal with this sort of issue. See the message below...: DIBP / ImmiAccount outage - Update The current problems being experienced with ImmiAccount and Legend are part of a more significant IT system failure which has also impacted the Department's internet and emails. The Department has advised they are working to restore the systems but do not have any timeframe for the resumption of normal service as yet. The Department has sent its apologies to MIA Members who have been inconvenienced.

04.01.2022 New country to be added to Australia's Work and Holiday visa program An agreement has been signed between Australia and Hungary to enable the countries' youth to experience each other's culture through the Work and Holiday (sc 462) program. Under the arrangement, 200 people who are at least 18 but not yet 31 years of age will be able to travel to each others country for one year and undertake short-term work and study under the Work and Holiday subclass 462 visa.... Similar agreements already exist with Argentina, Bangladesh, Chile, China, Indonesia, Malaysia, Poland, Portugal, Slovak Republic, Slovenia, Spain, Thailand, Turkey, the United States, and Uruguay. At present, only passports holder from the USA can apply online. At the signing ceremony earlier this week, the immigration minister, Mr Peter Dutton said that Australia will be working closely with our Hungarian counterparts to establish a mutually agreed start date for this arrangement as soon as possible. Similar agreements signed with Vietnam, Greece, Israel, and Papua New Guinea have stalled and not yet commenced. The Work and Holiday visa (sc462) differs from a Working Holiday visa (sc417) as it requires applicants to have the support of their government, hold or be studying towards tertiary qualifications and to speak functional English Currently, unlike the sc417 program, the sc462 program does not allow applicants to apply for a second year work and holiday visa. However, the DIBP has announced it is considering changes which will allow Work and Holiday (Subclass 462) visa holders to extend their stay in Australia by a further 12 months if they work for at least three months in agriculture or tourism in northern Australia Together, both the programs grew by close to 16% last year with the grant of over 258,000 visas. DIBP is reportedly looking to expand the program further saying that the program significantly benefits the economy in general and is of particular importance to the hospitality and tourism sectors. DIBP is currently in the process of negotiating new and more liberalised program with new partner countries including Mexico, San Marino, the Czech Republic, Latvia, and Andorra. The programs have been a popular stepping stone to the 457 visa and subsequently a permanent residence visa. Many skilled visa holders on this program with carefully prepared and planned migration pathways have successfully made the transition.

04.01.2022 Here's an update on how the budget is going to affect the Dept of Immigration and visa applications, including applying for new passports: Visa Application Charges will increase revenue by $79.4 million to $2,027.7 million. "This increase will be mainly due to an expected increase in visa applications". Tourist Visas will increase revenue by $1.5 million over four years from 2016-17 by introducing trial visa arrangements in key markets. This includes a user-pays visa fast-t...rack service for nationals from India and the United Arab Emirates, and a three year multiple entry visa for low immigration risk nationals from India, Thailand, Vietnam and Chile. Backpackers will pay 32.5 cents in every dollar earned in Australia from 1 July 2016 DIBP staffing will decrease from 13, 750 to 13,445 the cost of an Australian passport will jump $20 from January 1, 2017 to $274 raising $173 million over four years The fee for priority processing of passport applications will increase by $54 to $181 Streamlined Pathway to Permanent Residence for New Zealand Citizens: From 1 July 2017, New Zealand citizens will be eligible for this pathway if they were a resident in Australia on 19 February 2016 and, at the time of application, have lived here for at least five years and earned income of at least the Temporary Skilled Migration Income Threshold (currently $53,000 p.a.) over the qualifying period. Great Southern Kimberley Mid West Peel Pilbara South West Wheatbelt New applications for the Perth region remain suspended. Guidelines for certification remain the same as shown in the checklist for assessment. All applications (including those from the Perth region) received prior to the suspension of the program on 13 March 2017 will be processed according to the RSMS guidelines that were in place at the time of application.
