22.01.2022 **Biometrics collection appointments are re-opening** The Department of Home Affairs has indicated that from the 19 October 2020 the collection of biometrics services will resume at existing collection locations. Collection of the biometrics through the Australian Visa Application Centres (AVACs) and Australian Biometrics Collection Centres (ABCCs) will be dependent on in-country COVID-19 restrictions and applicants must adhere to these restrictions. Applicants wishing to co...mplete the biometrics requirements on their application can use their existing letter: Requirement to provide personal identifiers (biometrics) letter to book and attend an appointment. You must contact your local AVAC or ABCC to arrange an appointment and must also check the what the in-country restrictions are at that time. Some countries may have closures and restrictions and it is not required to contact the Department to inform them of this. Rather, it is suggested that applicants maintain contact with those centres so that they are aware when restrictions are lifted and the testing becomes available. Virtual ceremonies are being undertaken through video links with individual applicants or families and will be offered as an alternative to the usual face to face ceremonies. 19.01.2022 457 / TSS visa holders and Covid-19 Acting Minister for Immigration Alan Tudge, has indicated that if you are a sponsor for a Subclass 457 / TSS visa holder then you should be aware of the following: The employer can reduce the working hours of 457/TSS holders but should not reduce the hourly rate as this is not allowed unless the applicant specifically agrees to the reduction.... Employees who are stood down are considered to still be employed and will therefore not be subject to cancellation and it is generally acknowledged that the shortage that resulted in the visa will still be present when the Covid-19 crisis is over. Information regarding redundancies of 457 / TSS visa holders should still be sent to the Department in terms of the 28 day notification policy and the employees who are made redundant will be required to find a new sponsored within 60 days of the date of termination of employment. Sponsors continue to have an obligation to pay repatriation costs for employees and their families and this could be more expensive than reducing work hours or making arrangements for unpaid leave. Taking unpaid leave is acceptable and the employee will be considered to be in continuous employment of the employer. Visa holders can now withdraw up to $10,000 from their super for this financial year; Time worked with the employer prior to the COVID-19 pandemic will continue to be counted towards permanent residence after the crises has abated. The policy on this should be made available in due course.

16.01.2022 STUDENT VISA RELAXATION OF WORK RESTRICTIONS As a result of the COVID-19 epidemic changes have been made regarding the relaxation of the 40 hour per fortnight work restrictions for student visa holders within specific sectors. Student visa holders that are working within supermarkets may work longer hours if their employing supermarket had gained approval from the Department.... It is worth noting that this only applied to visa holders that were existing staff in existing roles where the applicant has/is assisting in the supply of groceries to and in supermarkets. This relaxation also applies to applicants that were working in an online distribution centre prior to the COVID-19 pandemic.

15.01.2022 **JUST ANNOUNCED** Mark McGowan has just announced that effective from 14th of November, pending ongoing health advice, the existing hard border exemption system will be removed and replaced with the controlled interstate border regime. The current exemption requirements for travel to WA from interstate will be removed. However strict conditions will apply to all travellers. These jurisdictions currently include Tasmania, Queensland, South Australia, Australian Capital Territ...ory and Northern Territory because they have had no community cases for more than 28 days. In order to travel interstate to WA you must complete the following Must complete a G2G pass declaration Will be subject to a health screening and temperature test on arrival at Perth Airport. Must be prepared to take a covid-19 test. The Chief Health Officer has recommended a 14-day rolling average of less than five community cases per day in each state and territory be required before progressing to the new border controls. This condition is currently being met. Travel from ‘low risk’ states and territories also permitted, with similar conditions on arrival, in addition to 14 days of self-quarantine and a mandatory Day 11 COVID-19 test. 14.01.2022 **NEW ZEALAND SAFE TRAVEL ZONE** Friday, 16 October 2020 saw travel from New Zealand to Australia open to allow for quarantine-free travel. Those who are eligible for this travel must: have been in New Zealand for 14 days or more and not been in a designated hotspot, and are travelling to Australia on a quarantine-free flight.... This is not just for New Zealand Citizens, however those who hold passports from other countries must also have a valid visa to travel to Australia. New Zealand citizens are granted a visa on entry and will be granted a Special Category visa (subclass 444) (SCV) on arrival unless they hold another visa subclass. The quarantine-free flights will only carry passengers who have declared they have been in New Zealand for 14 days or more and have not been in a COVID hotspot in New Zealand in the last 14 days before travel. These Quarantine-free flights are determined by the airline and will initially be bound for New South Wales and the Northern Territory only with other destinations being considered for a later date. Some states and territories may still require travellers from safe zone countries to quarantine on arrival and it is critical that travellers check the requirements of the state they intend to travel to. 08.01.2022 New Research on the impact of Covid-19 on the Australian workforce. Seek.com, one of the largest online recruitment sites have revealed that research done on their behalf in relation to the impact of the Covid-19 restriction show that the majority of candidates have experienced a significant change to their work situations. The most affected have been casual and contract workers with 30% of casual workers and 21% of contractors having either lost their jobs or been stood down. 06.01.2022 Current trends in processing of Visas Based on current trends within our office and the industry in general, the following appear to be the current trends in processing and granting of visas within the Covid-19 arena: Processing has slowed considerably, and many applicants are wait listed for a decision further down the track, however applicants are referred to the general processing times when queried.... The MIA has confirmed that requests to enter Australia by family members and critical workers are generally being refused and that it is difficult to obtain consent to enter regardless of the family situation. This is currently being confirmed within our practice. Employer sponsored visas processing has slowed dramatically and although unfortunate it is to be expected given the political view on migrants currently and the unprecedented unemployment figures in Australia at the moment. More queries regarding the requirement for a migrant worker have been received in the face of the unemployment statistics Although employer sponsored visas are still being granted, they are at a much slower rate than normal and most are for transitional visas. Nurses seem to be the most sought after occupations at this time. Permanent partner visas (Subclass 801) are currently being granted without much query and delay. Skilled visas, Subclass 491 and Subclass 190 are mainly granted for onshore applicants and a very small number of student and graduate visas have been approved onshore. There have been no approvals at this stage for the Subclass 408 (Covid Stream) Visa

04.01.2022 RELIEF FOR TEMPORARY RESIDENTS IN TASMANIA Tasmanian Premier Mr Peter Gutwein has stated that the state has introduced a $3 Million Dollar assistance package to temporary visa holders who are currently stuck in Tasmania due to the coronavirus pandemic. Visa holders who are suffering immediate financial hardship will be entitled to $250 for individuals and $1000 for families.
