22.01.2022 Before signing a Contract to purchase BUILDING & PEST INSPECTION Don’t skimp!... The cost of these reports equate to approx 0.1% to 0.2% of a purchase price. So, when you find that perfect must have property, arrange for these Inspectors to attend the property and provide you with a report so that you know what you are buying rather than going in blind and having a not so wonderful surprise after you move in. In one instance, a Purchaser was advised by a Building Inspector that the property needed approx $40,000 to $50,000 worth of work to repair issues. Needless to say and like many Purchasers, this Purchaser was not in a position to pay a further $40,000 to $50,000 over and above the purchase price for needed repairs. So, obtaining a report before you sign a Contract will provide you with some confidence as to whether you proceed to buy this property or at the very least with a ‘To Do List’ of what you will need to do after you move in. #presettlement #buildinginspection #propertysettlement #melbourne #acumenconveyancing #conveyancer

14.01.2022 Vendor When can I cancel? Failure to Pay Deposit Compared to the purchaser, the vendor has fewer opportunities to cancel the contract of sale. The most common reason for a vendor to cancel the contract is due to the purchaser failing to pay the full deposit.... Unfortunately for the vendor, the process to cancel the contract of sale is a longer process requiring a default notice to first be sent to the purchaser. This puts the purchaser on notice of their default and allows them an opportunity to fix the default. It is important that the default notice is in the correct form so that it will allow you to immediately end the contract if the default is not remedied and the reasonable costs and interest paid. 14.01.2022 Tip 6 After signing a Contract and Before Settlement Within the week prior to settlement, you will arrange with the agent to do a final inspection. If there is anything not quite right you need to say something so that the Vendor can fix or make sure it’s done, especially if these things are part of a condition contained in the Contract. 13.01.2022 Before signing a Contract to purchase CHECK ALL APPLIANCES ARE WORKING It’s also a good idea to check all appliances are working (eg stove, griller, oven, dishwasher, heating, cooling, alarm, etc), ‘coz you purchase any appliance sold with the property in its condition from the date you sign the Contract.... Disputes can occur and have occurred in the following instances: An oven is found to be not working. The electrical igniter may not be working. The dishwasher is not working. Ducted Heating may not be working appropriately. One instance involved minimal air flow being emitted from the ducts. Cooling may not be working and emitting warm and not cool air. The question then is: Was the appliance working at the time the Contract was signed? If not, then you have purchased the property with that non-working appliance and will need to have it repaired or replaced after settlement at your cost. If so, then the Vendor should repair/replace the appliance at their cost. If you did not check the various appliance/s before you signed the Contract, how do you know whether or not an appliance was working? Although it may be difficult to test these yourself without appointing a licensed tradesman or tradesmen to test the various appliances on your behalf, however as a general guide: in winter the property should be warm in summer the property should be cool With a dishwasher, you can always request for it to be operated so as to test its functionality that is, of course, if it is not being used as storage space in which case you can assume that the dishwasher is not working! With ovens and grillers, all elements or gas jets should activate when turned on. Be aware that you may not win a popularity contest by requesting appliances be turned on but I believe that you should know what it is you are purchasing and paying for. In both instances you should have pre-approval already in place. A pre-approval is an indication that you can borrow funds from the bank subject to certain conditions. The Plan enables you to check the dimensions of the land (preferably with a perambulator) and, in particular, that fences (if any) are in the correct position. You should also check the measurements from the nearest intersecting street as shown on the Plan.
