24.01.2022 ESTATE PLANNING REDUCES THE STRESS ON YOUR FAMILY. There are a few components that make up an effective Estate Planning Strategy. One of those components is a legally binding Will. Many people put off making a Will because the thought of their own mortality is too confronting. However, this could be to the detriment to your family; if you die without a Will:... 1. If your spouse re-partners, you will not protect your belongings from the new partner. It’s unlikely that if you die now your spouse will not re-partner during the remainder of their life. Any assets you leave to your spouse will become the property of any new relationship they enter into and eventually could pass from your spouse to their new partner, avoiding your children and other desired beneficiaries. 2. An administrator will be appointed to look after your estate. The administrator will disperse your money and your assets according to the law and not necessarily have any idea what you want to happen with your estate. 3. You cannot nominate a guardian for minor children without a Will. Your children might end up in the care of people you have not chosen. Where neither parent is alive, the grandparents become the natural guardians of your children, but it is up to a court to decide which set of grandparents. 4. Your assets may be divided equally among your children but you may not want this. For example, if you do not have a Will, you won’t be able to protect your assets from any adult child’s creditors or from the financial pool if your adult child is going through a divorce. 5. You cannot leave contributions to a charity, church or to care for your pets. Only a Will can specify how your money can pass to your favourite charity or favourite furchild. Your Will is a legal document, and while you can buy a cheap generic 'one size fits all' Will Kit for a few dollars, your Will should be drafted by a solicitor. Everyone's circumstances are different and should be taken into account when drafting a Will, only a solicitor can do this for you. A solicitor can help you prepare by creating your Will correctly and minimising any chances of your Will being invalid and open to disputes. Are you prepared?
