24.01.2022 First Sponsored Parent Visa Granted The Sponsored Parent (temporary) visa (subclass 870) was introduced in April 2019. The Minister confirmed that parents from South Africa, Venezuela, China, South Korea, Bolivia, the UK, Egypt and India will soon be in Australia with their families after being granted the first visas under the Morrison Government’s new Temporary Sponsored Parent Visas. Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs David Co...leman said more than 1300 sponsorship applications and 170 visa applications have been lodged and visa grants have already started. As expected there has been strong demand for the new visa, Mr Coleman said. The subclass 870 visa will allow your Parents to come to Australia for 3 years or 5 years. Parents must have an Australian child who can sponsor their application. The child (and their partner) must have a combined income of at least $83,454.80. A visa fee of $5,000 is payable for a 3 year visa or $10,000 for a 5 year visa. The advantage of this application, as opposed to the Parent or Contributory Parent Visa application, is that there is no balance of family test. It also has the advantage of being processed in much less time then the Parent visa (which is currently taking 30+ years to process) and much cheaper then the Contributory Parent Visa (which currently attracts a secondary application fee of $43,600 per parent). 21.01.2022 Honesty is important when preparing a visa application. In my career as a Migration Agent I can recall a number of clients who were not honest with me or the Department of Immigration. Two clients come to mind. The first client, from Northern Ireland, failed to tell me that he had gotten into a bar fight and accidentally killed a man. He had been charged with involuntary man-slaughter. This became apparent when he provided to me his police certificate. This incident changed ...our entire approach to his visa application which, I am pleased to say, was approved. However, had he advised me of this incident when we first met it would have saved a lot of time and expense. The second client, from Spain, forgot to mention that she had a pace-maker installed to regulate the contractions of her heart. This became apparent to me and the Department of Home Affairs when she completed her health examination and was referred to the Commonwealth Health Officer. Again, the visa was approved. Having previous criminal convictions or health concerns will not necessarily prevent a visa application from being approved. However, providing fraudulent documentation or unsuccessfully trying to deceive the DHA will! Honesty is the best policy to adopt when dealing with Australian Immigration. 21.01.2022 PARENTS Commencement of the five year subclass 870 Sponsored Parent Temporary visa is set to commence 17 April 2019 The new temporary parent visa, subclass number 870, will commence 17 April 2019 according to the Department of Home Affairs’ (Home Affairs’) website. Up to 15,000 of these visas will be granted each program year.... The application will be processed in two parts: A) Sponsorship Application by eligible Australian citizen, permanent resident Child. The fee will be set at $420. B) Visa application $5,000 for a visa of up to three years’ duration; or $10,000 for a visa of up to five years’ duration. The visa application charge is payable in two instalments, with one payment at time of application and the remainder paid prior to visa grant. The visa application charge represents a contribution to the cost of the services parents will use in Australia for extended periods. Most visa holders will have never paid tax in Australia but will benefit from using existing infrastructure. The charges also reflect that there are benefits for both parents and their Australian families. The visa holder can stay in Australia for up to five years continuously (up to a cumulative maximum of 10 years), thereby saving on the cost of airfares that would be incurred over this period if they were required to depart and re-enter Australia on a regular basis. The government announced an increase in the number of visa places for regional Australia with 23,000 skilled visas being reserved for those willing to live and work in the regions. Two new provisional regional visas will be introduced in November 2019 Skilled Employer Sponsored Visa and Skilled Work Regional Visa - will have 9,000 and 14,000 places respectively. These places will be part of the revised annual immigration cap of 160,000.... Visa validity will be up to 5 years. Visa holders will be required to demonstrate they have lived and worked in regional Australia while holding one of the new visas for at least three years in order to become eligible to apply for permanent residency. A new regional permanent visa will be introduced in 2022. 'Regional Australia' will be simplified and expanded in November 2019 to include all of Australia except for the following metropolitan areas: Sydney, Melbourne, Brisbane, Gold Coast and Perth. Caller: My name is Dwayne and I have hurt myself and need to take leave from work for 3 months to recover from an injury. I met a girl in the Philippines last year when I was there on holiday. Me: Ok Dwayne: I would like her to come to Australia to visit and look after me. She also wants to check out Australia to see if she likes it and we might apply for a Partner visa. I will be supporting her visit as the salary she earns from her job is very low. She does not have any savings and lives at home with her family. It is at this point I have to explain the difficulties Wayne’s new found love will have getting a visitor visa. I receive inquiries like this in regards to visitor or tourist visas every day. What might seem like an easy visa to obtain is not always the case. The DHA must consider: a) Previous migration history and compliance b) Whether the applicant intends to comply with the conditions of the visa c) Any other relevant matters (i.e. Personal circumstances, Credibility, Purpose and period of stay, Previous immigration/travel history, Intel reports and profile) The case officer will consider the applicants reasons for returning to their home country i.e. do they have a job, do they have family, do they have assets and responsibilities sufficient enough to incentivise them to return to their home country. Some typical reasons or profiles that may see a visitor visa refused: 1. Applicant is single, does not have full time employment (or does have employment in a lowly skilled and lowly paid position) or any significant assets to return to when their visa expires 2. Applicant intends to visit a friend in Australia that they met online and is considering lodging a further visa application whilst onshore 3. Applicant intends to seek work 4. Applicant comes from a country afflicted with conflict 5. 09.01.2022 Hello again I hope you have all been keeping well and are getting into the spirit of the happy season! It appears that both sides of government are now fully into election mode and doing their best to obtain support for the upcoming vote. This week, across all media, it was announced that the Federal Government will be reducing permanent migration from 190,000 per annum to 30,000 per annum. It was also announced that more priority would be given to regional immigration.... According to Prime Minister Scott Morrison this was to reduce rising population pressure in Sydney and Melbourne. This is a simple tactic to get votes for the election as recent surveys revealed two-thirds of Australians believe that Australia is full and it is putting pressure on housing prices, jobs and infrastructure. Australia is not full. Our population is under 25 million. So come on.. Australia needs good infrastructure, transport, housing, roads and hospitals. If this is achieved then the pressures of living in Sydney and Melbourne will be reduced. Both cities are now experiencing the headaches of poor planning by previous state and federal governments with Sydney being virtually one big construction site as it hurries to make up for lost time. The pressure is being felt in Sydney because our infrastructure is poor. The government is diverting attention from their own mis-management to our annual migration intake. Mr Scott Morrison, let’s get real. Nevertheless, we need to roll with the punches at least until the Federal Elections are completed and the dust settles. The announcement this week was in regards to permanent immigration, not temporary migration (i.e. work permits, employer sponsored visas, student visas, visitor visas etc). If you meet the requirements, you will still qualify for a visa. Don’t let this announcement discourage you. This will certainly make you less confident when submitting an application without professional assistance. This means that a registered migration agent really can assist you to complete a full assessment of your eligibility and give you that peace of mind (which I talked about in my last video). 09.01.2022 The East Coast of Australia has experienced all seasons this past week. Sydney had dust storms early in the week and then a months worth of rain in just a couple of hours on Wednesday. Our alpine region, between Sydney and Melbourne, received 20cm of snow whilst Queensland are currently battling blinding heat and bushfires. Let's hope that the weekend brings some calm and peaceful weather!

The 45-year-old had failed to declare 10kg of squid, quail and cooked pork products that were found in her luggage. "If you are travelling from an African swine fever country - we are watching you," Agriculture Minister Bridget McKenzie told reporters in Canberra on Tuesday.

06.01.2022 The federal government has launched a major review into the skilled migration occupations list, with hopes that new tech job categories will be included in the mainstream program. Employment Minister Michaelia Cash says skilled migration is needed to support the government $100 billion infrastructure roll out. The review will inform the government’s updating of the occupations list in March next year, with labour market analysis and public consultations to also be undertaken.... Immigration minister David Coleman said the new review aimed to ensure that businesses can access workers to fill critical skills shortages. The Morrison government is continuing to look closely at ways of filling these skills gaps in regional areas and giving businesses more certainty and confidence that they can get the workers they need, when they need them, Mr Coleman said. In an effort to bypass this, the federal government made the Global Talent Employer Sponsored visa scheme permanent earlier this year. The scheme, designed for tech companies to attract overseas workers for niche, high-skilled jobs, is not restricted to the occupations list. A 12-month pilot of the GTES scheme saw 23 companies enter into an agreement with the government to access fast-tracked visas for jobs not included in the skilled migration occupations list. As part of the review the ANZSCO will also be revised and it can be expected that some new job categories are introduced. This will then enable their inclusion into a revised SOL (Skilled Occupation List). With the introduction of two new regional visas in November 2019 and the announcement of this review to occur by March 2020 it is certainly going to be an interesting time. This area of migration to Australia is, and will continue to be, a dynamic and competitive steam of immigration. (As a Republican it still amuses me that we require approval from the Queen of England but that is beside the point). Once the Queen does approve the bill it will mean, amongst other changes, that the sponsorship and visa applications become separated. Before a valid visa application can be submitted a sponsorship application must be submitted by the Aust...ralian partner and approved. This becomes critical if you are onshore and have limited time before your current visa expires. It will mean that you become reliant on the DHA to make a positive decision on the sponsorship application before you can apply for your partner visa and obtain a bridging visa. The ramifications of these changes are big! If you are considering a partner visa then I would suggest you get some advice and try to lodge an application before these changes become law.
