24.01.2022 Authority to Act Before starting to perform any functions of an estate agent the OIEC, or principal estate agent, must complete the Authority to Perform Duties of an Estate Agent (Authority to Act) specifying the functions an agents representative can perform. Where the functions originally specified in the Authority to Act are narrow, or limited to one department only such as property management, a second Authority to Act would need to be completed at a later stage if the agents representative expands into a sales role. 23.01.2022 ESR and Authorities An estate agent is required to provide a Vendor with their estimated selling price/range prior to having the authority signed. This means that the estate agent is required to have already determined which three comparable sales (except in instances where the agent reasonably believes that there are none) they are taking into account to set their estimated selling price/range at the time of preparing the authority!



22.01.2022 Agent's ESP and Vendor's Price There is nothing in the Estate Agents Act 1980 that requires the agent's Estimate Selling Price (ESP) to be the same as the Vendor's Reserve (Price). The agent's ESP must be reasonable and based on their three comparable sales. An agent should not be influenced by the Vendor's Reserve (Price) when determining their ESP.

22.01.2022 Completing Authorities and Entitlement to Commissions Before obtaining a vendor's signature on an authority, the Estate Agents Act 1980 requires agents to disclose the details of all commissions agreed with the vendor, stated as a dollar amount or a percentage (if a percentage is stated, an example of the dollar amount it represents must also be given), a rebate statement using the wording approved by CAV, details of outgoings such as marketing (leaving this section blank or ...with a TBA does not suffice) and a statement, using the wording approved by CAV, advising where a complaint about commissions or expenses can be made. 17.01.2022 Comparable Sales - Facts Vs Myths After speaking a few estate agents this week, I just wanted to dispel some myths around comparable sales and agents setting an ESR. 1. Comparable sales are selected first and foremost around the standard, condition and location of your listing property and not the sale price!... 2. Find your comparable sales first then set your ESR. 3. There is no rule that states that the ESR is to be within 5% either way of the comparable sales selected. Your ESR needs to be reasonable and take into account the sales prices of the three comparable sales selected. Whatever ESR you determine may be supported through internal file notes to justify your price. Myths busted! Please share with someone who may find this helpful!
