23.01.2022 ARRCC supporter Catherine Ward who, along with Linda Wannan has just been to the Indian Consulate General in Melbourne this morning in order to hand deliver a letter from ARRCC asking them to pass on an urgent message to the State Bank of India not to lend Adani nearly $1 billion for their mine. The best information we have is that the Bank is due to make its decision very soon indeed. They held this peaceful action of resistance on Friday, to challenge Aurizon to be transparent about the emissions from the coal it hauls each year, not just the emissions from its day-to-day operations. 14.01.2022 Today Adani have once again used their attack dog legal strategy against a community activist in a desperate attempt to silence dissent. Ben Pennings is a courageous, admirable man. A billionaire mining giant using the law to intimidate its opponents is disturbing, but it wont work. Adani used their attack dog legal strategy to bankrupt Wangan and Jagalingou spokesperson Adrian Burragubba, and W&J people are still continuing their courageous fight for land rights, stand...ing their ground on Country right now. Adani can try and intimidate individuals but they can not stop an idea whose time has come and with right on its side. There is a growing movement of people who know we must stop Adanis coal mine to stop climate breakdown, protect water and defend Aboriginal land rights. There are many people of faith across Australia who care deeply about this. We are with you, Ben, and we will not be silenced by a bullying corporation.

Possibly as a result, the issue has now been referred to a parliamentary committee. The committee are taking submissions from the general public until next Friday 11th. 12.01.2022 The Anglican Dean of Brisbane, Peter Catt, has released a statement in support of the environmental activist, Ben Pennings, and said a court-ordered injunction ...against him was a sad indictment. The injunction, sought by the miner Adani and granted by the Queensland supreme court, orders Pennings to remove social media posts and other content soliciting information about Adanis Carmichael mine. In a statement, Catt compared Pennings to anti-slavery and suffrage activists, who were punished by the legal or political systems of the day. "It is a sad indictment that a local man who has been fighting for transparency has been gagged including from engaging in personal social media activities. The irony of this is not lost on any of us who support the right of individuals to use their personal social media channels for the common good. Despite todays setback, I join the many others who are inspired and encouraged by people like Mr Pennings who strive to keep our communities healthy and safe and at great personal and financial expense. His courageous example will surely motivate other Australians to join the growing movement to protect our iconic Great Barrier Reef and the underground water sources that our farmers are so reliant upon." 07.01.2022 BREAKING: Adani ordered to pay exploited customers $100m (article below by Vanessa Marsh, court reporter, The Courier-Mail) Mining company Adani has been ordered to pay more than $100 million to customers of its Abbot Point coal terminal after a court found it had engaged in unconscionable conduct and exploitative and dishonest behaviour.... The legal dispute arose between the Adani Abbot Point Terminal and four users of its port Lake Vermont Resources, QCoal, Byerwen Coal and Sonoma Mine Management in relation to the charges the companies were paying for access and handling at the North Queensland port. In a judgment handed down late yesterday, Justice Jean Dalton ordered the Indian mining giant pay $37.9 million to Lake Vermont Resources, $25.3 million to QCoal, $31.7 million to Byerwen and $11.9 million to the Sonoma Mine. She found Adani had not given its port customers reasonable charges for use of the facility and had engaged in dishonest behaviour and went out of its way to structure transactions so that it received an extra $255 million payment. The applicants conduct was deliberate, not just heedless or indifferent to the position of the remaining users, Justice Dalton found. The applicant was fully cognisant as to the effect its behaviour would have in increasing the fixed costs to the remaining users. It desired that effect in order to advantage itself financially. That is, to achieve a gain for itself, the applicant engaged in calculated behaviour to the disadvantage of the respondents. Justice Dalton said the company engaged in disguising and camouflaging behaviour and made a dishonest attempt to defeat the respondents exercise of their legal rights. An Adani spokesperson said the company was carefully considering the judgment.
