25.01.2022 Family courts need urgent funding injection says Law Council 1 February 2020 New figures from the Productivity Commission show delays across the family law system are reaching alarming levels, according to the Law Council of Australia.... Statistics in the Report on Government Services released this week reveal the backlog of family law cases between 2012-13 and 2018-19: In the Family Court has grown by 34 per cent; and In the Federal Circuit Court has grown by 63 per cent. Law Council of Australia President Pauline Wright said a real concern was the increase in the number of cases more than a year-old waiting to be heard. Justice delayed is justice denied, particularly when some of these cases involve some of the most vulnerable in our community and allegations of domestic violence. An urgent injection of funds into the family law system is required, Ms Wright said. This week saw the finalisation of Stephan's matter where he now has orders for equal shared parental responsibility and 43% care of the children. When Stephan came to us for help, he was dejected and frustrated with the whole system - he felt that the Mother's risks were being overlooked and the allegations against him were amplified. 07.01.2022 This week our Principal Lawyer, Albert, represented a client in court seeking ex-parte orders to protect her child. Penny had concerns her ex had relapsed into ICE drug abuse when her son, Toby, had returned from a recent visit with an injury to his face. Penny had also heard from acquaintances that her ex had returned to abusing drugs. On Albert's advice, Penny tried initially to resolve the issue directly with her ex. When this proved fruitless, Albert filed an application ...into court seeking the suspension of the existing orders and the restraint on the ex from coming into contact with Toby. When the matter was before court, the judge made all the orders Penny sought and also ordered the ex to undergo drug testing. With Albert’s argument, the judge was adequately satisfied that those orders be made on an ex-parte basis. 06.01.2022 In Elizabeth’s matter this week, she represented Fiona, whose ex-partner had withheld the children for over a month. The Father alleged that Fiona had put the children at risk. Due to the Father’s history of violence towards Fiona and the children, Elizabeth persuaded the Court that it would be in the children’s best interest to be returned to Fiona. Elizabeth also submitted that any perceived risks to the children could be mitigated by particular injunctions. Furthermore, th...e Court ordered a hair follicle test due to the Father’s history of drug abuse and time arrangements would commence for the Father to spend time with the children on the basis that his results show a negative result. Ultimately, the Court granted the order for recovery and the children were successfully returned to Fiona. 06.01.2022 In the run-up to Christmas, AS Family Lawyers remains as busy as ever. This week, Elizabeth, was in a 4 day final hearing. Albert was in court in a number of matters - one where he managed to have the matter transferred to Melbourne to suit the Mother with a very young child, and another, where he was successful in recovering a child to the Mother's care. 03.01.2022 Over a year ago, Rodney sought help from us as he had not been able to spend time with his children for several years. Over the weekend, Rodney had his first scheduled visit to spend supervised time with the children. He was told prior to the visit that the children did not want to see him and were extremely resistant. The children only wanted to ask him some questions and then would likely end the visit with him. Once the visit started, naturally the children did have ques...tions. Rodney was able to approach this interaction in a child-focussed manner and the children’s initial confusion and resistance disappeared. The children and Rodney were able to start their relationship anew with a greater understanding. The children then proceeded to have an extremely positive visit with Rodney, ending with lots of cuddles and excitement about the next time they would spend time with their father. 02.01.2022 A good win today for AS Family Lawyers, helping a client recover her children from Queensland. John had taken the 2 girls, Katie and Rebecca, to Queensland. John did have primary care of the children, but his unilateral actions in relocating interstate, meant Linda could not maintain a proper relationship with the children. Linda sought our advice and today we managed to achieve court orders for the children to return to Sydney.... 02.01.2022 Brayden is spending time with his children this weekend, for the first time in 6 months. Brayden and Stephanie split last year. There was a period when Brayden continued to see his children, but that stopped shortly before Christmas last year. At the beginning of this year, Brayden attempted mediation with Stephanie, but it was not successful.... Brayden was at a loss as to what to do. He struggled with the issue of court proceedings versus the cost involved.
