21.01.2022 Australian Competition and Consumer Commission (ACCC) v Harvey Norman Holdings Ltd Harvey Norman has been fined $1.25m for misleading advertising. Over a two and half year period, the retail giant's catalogues conveyed the impression that the goods and prices advertised were being offered by Harvey Norman franchise stores generally whereas the offers were really being made only in respect of one store in each State or Territory. Harvey Norman also advertised that 3D televisio...ns purchased at franchise stores could be used to watch the AFL and NRL grandfinals in 3D format but that was not the case for customers in regional areas. The Federal Court described Harvey Norman's conduct as an 'expensive, misleading and calculated campaign of sizeable proportions, characterised by blatant and deliberate disregard of the truth, cynical strategies to capitalise on contemporary sporting events and the contemptuous manipulation of ordinary customers'. 04.01.2022 Moti v R [2011] HCA 50; BC201109425 - 07 Dec 2011 - High Court of Australia - Judge(s) French CJ, Gummow, Hayne, Heydon, Crennan, Kiefel and Bell JJ The High Court has granted a permanent stay of the prosecution for child sex offences against the former Attorney-General of the Solomon Islands, Julian Moti. The Court found that Mr Moti's deportation from the Solomon Islands was not only unlawful under foreign law, but facilitated by Australian officials who had knowledge of its unlawfulness. Mr Moti's prosecution was therefore an abuse of process. The Court found it necessary to comment on the legality of the conduct of a foreign State because such conduct was a preliminary to the determination of whether a stay of prosecution should be granted. Justice Heydon vigorously dissented.
