24.01.2022 Success Story: A few years ago we had a public sector worker complain to us about workplace bullying and harrassment. The worker wanted to leave the workplace and hopefully pursue $30,000 in redundancy pay. He claimed his manager wanted him to leave voluntarily despite working in the same position for seven years. ... Our office submitted a strongly worded letter to the CEO of the employer highlighting several breaches of the Fair Work Act as well breaches of the law in his personal capacity. The government agency responded positively at first, but within two weeks suspended our client with full pay on allegations of bribery, fraud and vandalism. We later submitted evidence these allegations were fabricated by a manager of the employer. Our client remained suspended on full pay for 12 months before terminating him. We then commenced legal action. The employer settled, agreeing to pay our client $70,000. We could have asked for more. Our client would have been happy with $30,000. He was paid more than that over the 12 months he was suspended with full pay. As he had a baby he agreed to settle and not take the matter to a hearing. The settlement was a welcome bonus.

22.01.2022 Delivery riders should not be using their bicycles in tunnels. This seems to be a growing problem Pelumba penghantaran tidak boleh menggunakan basikal mereka dalam terowong. Ini seolah-olah menjadi masalah yang semakin meningkat

16.01.2022 Our firm is assisting farm workers in QLD organise their own labour hire services so as to avoid paying an illegal labour hire contractor 1/3 of their wages. In Victoria we are working with liquidators to claim superannuation, award wages and entitlements on behalf of a dozen workers after they sell off properties owned by the now bankrupt labour hire company. Elsewhere we are assisting a farm worker who was mauled by farm dogs and then abandoned by a contractor at the front ...door of a hospital. Over the last three years we received complaints at some of Australia's largest packing companies that bring goods to our national supermarkets. Modern Slavery is big business and well entrenched. Fines and prosecution don't always work. Always get advice from an employment lawyer who has experience in dealing with these issues. 15.01.2022 From 1 July 2019, the national minimum wage will be increased to $19.49 per hour. This change in the minimum wage will affect 2.2 million employees. We urge all... employees to check they are being paid over the current minimum of $18.93 per hour, and to ensure their employer applies the wage increase in the new financial year. We urge all farm and factory workers who are paid under piecemeal rates (per bucket/trolley/bin) to ensure they are getting paid an equivalent rate per hour.

09.01.2022 Modern Slavery is a reality in Australia. Many products we commonly find in a supermarket are tainted by some form of unethical practice along the logistics supply chain. This article by Professor Burn (UTS Anti Slavery Project) gives some examples of how modern slavery manifests itself. https://theconversation.com/human-trafficking-and-slavery-s

05.01.2022 We support a plan to remove a cap on parenting visas. If a 3-year student visa can cost less than $600, why does a 5 year parent visa come at a cost of $10,000? Migration agents see fewer refusals for a parent visa than for a student visa. It is less risky and less likely to be abused. ... The figure seems quite arbitrary and we question the motivation of the Howard Government which implemented this policy.

03.01.2022 As the old saying goes "the more things change the more they stay the same." Farm workers need to take responsibility over their own payments and to insist on better working conditions in order to benefit from this ruling.

01.01.2022 How much are you owed in wages and entitlements from your employer? One of our clients approached us seeking $1500 in unpaid wages and a further $2000 because ...his employer withheld work for four weeks. He previously complained to the fair work ombudsman. Nothing happened at the fwo and the case worker failed to advise our client he had 21 days to lodge a claim for unfair dismissal. We commenced a claim in the federal court and settled his claim for $15,000.
