24.01.2022 Settling on responsibility for incidents in a landlord vs tenant situations can be tricky to say the least. Mould in rental properties is one of those events - how do you know who is responsible? Let’s talk about responsibilities. Landlord obligations include making sure the home is in a reasonable state of repair, meets building, health and safety requirements and that repairs are undertaken in an appropriate time frame. ... Tenant obligations include keeping the property clean and well maintained, not causing or permitting damage to be caused to the property and notifying landlords about damage as soon as possible. So who takes the blame for mould? Well, it depends on the cause. If the tenants actions or negligence led to a mould infestation (e.g. getting the carpet wet and not drying it out correctly or not airing out bathroom/wet areas correctly) then they would be at fault. However, if mould develops due to the landlord not handling maintenance correctly (e.g. leaking or broken pipes) they would be at fault.
