21.01.2022 Negative Gearing - will the Government tinker with tax relief for investors! Negative gearing is a result of the negative out flow of owning property or other assets via a loan. Its basically where the interest and other expenses are greater than rental income received. The shortfall can be offset against other income thereby saving you taxes. Many Australians enjoy the benefits of property investment and negative gearing.... So with the upcoming budget will the Government change the rules? Well in 1985 the then Hawke Government did change the rules by only allowing new properties to offset negative losses against future rental taxable income. There was such an outcry that they repealed the legislation 2 years later. Will any future governments change the rules? Maybe !. There has been some commentators mention that the Government should limit the tax relief to new homes only. What happened in 1985 was that the rules created difficulty being consistent with the remainder of the tax act. It would take a brave Government in deed to change a rule that so many Australians enjoy and aspire to have a negatively geared property. Is negative gearing all positive stuff? 15.01.2022 Trust me - using a family trust vs SMSF There is a lot of media attention on SMSF and property borrowings but using a Family Trust also can provide spectacular results Many commentators focus on the benefits of using a SMSF and how property can be acquired using borrowings within superannuation. SMSF is fantastic for saving for retirement but is it always appropriate for your circumstances? ... Family Trusts, often referred to by many as for the rich and famous can be a great vehicle for estate planning A Family Trust will outlive a SMSF anytime. This is because a SMSF will only last as long as its members and when the last member departs so must the Assets. Where as a Trust can last for generations; up to 80 years in fact till the Trust needs to vest. This often at least 2 generations of families. The common question many ask me as a tax advisor is that will the government outlaw trust or arent they almost illegal ?. To be honest there is more control and regulation over SMSF than Trusts at present and its going to get worst. There has been lost of noise about SMSF space and will they be taxed, the SMSF space is very unclear. So if as long as you use a Trust correctly and not distribute profits to the family cat , dog or next door neighbour , amazing results can be achieved for both general tax planning and long term estate strategies. When using a trust it should be noted that a beneficiary cannot bequeath trust property their will. The trust property belongs to the Trust and the trustee determines its use etc. What happens to the trust property or the portion of income to the beneficiary upon the death of the beneficiary will only be decided by the Trust Deed for the Family. Each persons circumstances are different so it is important to obtain good advice before using a Family Trust or a SMSF. The advice provided here is of a general nature

06.01.2022 Lots of talk about how hard it is for the young buying a house . Here is how one young man did it. I like the first paragraph where he reckons you need to live and be nice to your parents until age 23. Really !!! I expect my billy lids wont leave the local parents hotel until their late 20's . Any why wouldn't you hang around with good food , free washing but no ironing, beer in the fridge, Netflix and free wifi what more does a big kid want. !!
