25.01.2022 Please join us for the first Melbourne Local Circle Meeting for 2019 with special guest presenter, Adriana Orifici, Lecturer at Monash University, Melbourne. Adriana Orifici is a Lecturer in the Department of Business Law and Taxation at Monash University and a member of the Labour, Equality and Human Rights (LEAH) Research Group. Adriana researches in the areas of Australian labour law and anti-discrimination and equality law. Adriana holds a Bachelor of Arts (Hons) and Bac...helor of Laws (Hons) and Master of Laws from Melbourne Law School. She is completing her doctoral studies in the Centre for Employment and Labour Relations Law at Melbourne Law School. Her PhD research examines the legal regulation of workplace investigations and uses doctrinal and empirical research methods. Adriana has been examining the legal framework of workplace investigations. She will be presenting her recent research on one issue in detail: the potential application of private security laws in each State and Territory to workplace investigators and those who engage them and will be opening up a discussion with the group. She reminded attendees who are involved with investigations and who have a lot of experience and insight, that they could make a positive contribution to the discussions and decision making about how an investigation is scoped and conducted. ... In some, if not many cases, the employer has less experience than the investigator in such matters. Graeme Colgan, former Chief Justice of the Employment Law Court of New Zealand, as conference guest speaker was able to share the experience of NZ investigators, outlining some of the differences between NZ and Australian practice. For example, how the NZ employer may provide an investigation report to the parties, and the legislated role for the principle of trust and confidence. There are, none the less, many similarities and a look at recent NZ case law reminded us that principles concerning conflicts of interest, the necessity to follow procedures outlined in enterprise agreements, and the fact as investigators are agents for employers they need to ensure their actions do not lead the employer into legal difficulties. #AAWIConf18 #AAWI #AWI #Investigators #Investigations

Co-Convenor Karen Streckfuss (Vicbar) closed the conference and conveyed the general consensus that the second conference was successful in terms of bringing people together, and that another conference was already being considered. The social activities were relaxed and meant that participants were able to meet each other and form connections across States, countries and jurisdictions. The advisory committee and administrative assistant Ellen McIntyre were duly thanked. Participants were encouraged to become involved in the various activities on offer. 17.01.2022 AAWI Conference 2018 30 - 31 August 2018 | Kingscliff New South Wales What every investigator should know about the Fair Work Commissions Anti-bullying jurisdiction... The AAWI conference was fortunate to have the head of the Stop the bullying jurisdiction, Commissioner Peter Hampton, address it - and he did not disappoint. He provided insight into how the bullying provisions can apply more broadly including naming an investigator in addition to other staff of an organisation as a party. 700 800 applications are filed per year, and only a small proportion of these result in final orders (12 matters to date). The Commission is now able to outline some themes after analysing the applications filed, including whether applicants have reported the bullying prior to lodging their claim, and whether the employer has complaint handling procedures. Unsurprisingly, the answers from applicants and employers in the same organisation does not always marry up. Whilst an investigation may be part of an employers defence, it wont serve as a substitute of the Commissions own findings. He commented on internal and external investigation reports, as well as those he referred to as litigation defence reports. He urged parties (employers) to take into account how the applicant will perceive the findings being made by an investigator (particularly if they are not clear), and how they are not always constructive and can lead to further disputes if not carefully communicated. The Commissioner also observed that the other parties that are brought into an application because they have been named, may also be in need of support and welfare checks. The AAWI looks forward to maintaining an active dialogue with the Commission. As a professional group who is impacted by the decisions of the Commission either directly through being roped into an application, or indirectly through its decisions, we must continue to understand how investigations are viewed and relied upon in Fair Work Commission proceedings. #AAWIConf18 #AAWI #AWI #Investigators #Investigations

The AAWI conference provided another dimension to the work of investigators in the discussion by the corporate panel about in-house investigation work, as well as the briefing out of work to external investigations. Representatives from IAG, Rio Tinto and Virgin. Jenna Pervan, Fiona Forrest and Melissa Bostock, touched on some of the challenges of working in house, the role of team work, and how self-care strategies and proper training for the employees who do this type of work is so vital. The AAWI conference benefitted from the insights of three experienced government lawyers who shared the complexities of their work through the prism of various specialised legislation that government investigators commonly have to work with. Angela Stoler, from the Department of Justice and Regulation (Vic), outlined how exactly the Code of Conduct affects most matters that come under investigation. Richard Harding, at AGS, advises government clients about the Public Interest Disclosure legislation and whistleblowing and helps assess and guide these investigations which are highly regulated. Neil Lawson, Qld Dept of Justice and AG , provided practical tips on how to navigate the particular more difficult parts of public sector investigations. 12.01.2022 AAWI Conference 2018 30 - 31 August 2018 | Kingscliff New South Wales Workshop: Best practice in workplace investigations ... The conference concluded with a final conference session that involved beginning the journey of developing Australasian standards. Small groups examined the AWI guiding principles through an Australasian lense and then shared their discussion with the wider group. The next step will involve reviewing this work, and disseminating it to the local circles for further feedback. A goal was set to have these developed by the next conference if possible. The session also involved the facilitators Joanna Betteridge (Betteridge Consulting), Elizabeth Devine (Devine Law) and Daniel Smith (Ashdale), summarising the key points from the each conference session. This was a stunning session, as two people acted out three scripts of the types of responses from complainants/respondents to investigation process. They were stories that resonated, and reminded attendees of the human dimension of investigation work, and the harm that can be done (even when not intended and where great care is taken). Graham Andrewartha (McPhee Andrewartha), Verena Marshall (Skill Matters, and actor) John Boardman (iHR), as well as the paid actor, unpacked some of the psychological aspects of handling parties, as well as oneself, and a brief overview of the work of David Rock and other research, provided reason for self-reflection in this session. #AAWIConf18 #AAWI #AWI #Investigators #Investigations

06.01.2022 AAWI Conference 2018 30 - 31 August 2018 | Kingscliff New South Wales Ethics and Practice Session: An ethical framework for investigators... The ethics session was wellreceived and thought provoking, as judged by the many questions and comments. Michael Robertson (who works as a an academic as well as at Q Workplace Solutions) and Raelene Speers (Department of Health Qld), contributed to the panel discussion ably led by Rose Bryant-Smith (Worklogic). The challenge thrown to the AAWI conference and members was how to start to think about an ethical frame work for workplace investigators. Investigators have a purpose specific role, grounded in impartiality, non-partisanship, disinterestedness and justifiable decision making, and thus some guiding principles would assist investigators and contribute to ensuring a sound process is followed. Currently there is no statement concerning ethics in the material produced by AAWI and the discussion that ensued suggested that there was a desire to explore a Code for the Australasian chapter. #AAWIConf18 #AAWI #AWI #Investigators #Investigations
05.01.2022 AAWI Perth Local Circle Meeting Report Once again, the recent AAWI Perth Local Circle event was a success. On Thursday 4 April, K&L Gates kindly hosted the first Perth Local Circle meeting of 2019 on their stunning St Georges Terrace.... Over 20 guests attended the meeting to hear the former Commissioner of the Fair Work Commission, Mr Danny Cloghan, speak about what three ingredients make up a good investigation. The first ingredient is learning, the second is yearning, and the third unveiled at the meeting was earning! Mr Danny Cloghan, was an excellent speaker and his willingness to share his time and expertise in the area most certainly contributed to the success of this event. Our members are becoming more pro-active and seem to be seeking more specific discussions, speakers and topics focusing on workplace investigations.
