25.01.2022 Changes to the Miscellaneous Award 2020 effective 1st July 2020 The Fair Work Commission has made some changes to the Miscellaneous Award 2020, effective from the first full pay period on or after 1 July 2020. These changes include: ... The Miscellaneous Award 2020 has been varied to clarify who it covers. The clarification means employees who were previously not covered by an award, might now be covered. If an employer is covered by an industry award (for example, the Retail Award) and there is no classification in that award for the employee, the Miscellaneous Award previously couldnt cover them. Now, the Miscellaneous Award 2020 could cover these employees. 25.01.2022 EMPLOYER PENALISED $276,929 FOR UNDERPAYMENT OF WAGES On the 27th August 2020 the Fair Work Ombudsman (FWO) released an article in relation to another underpayment of wages case, a timely reminder to ensure your company is compliant. The Fair Work Ombudsman found the former operator of 2 juice outlets, Hello Juice, Werribee & Geelong underpaid employees a total of $38,458 including ten juniors under the age of 18. The FWO reported that Hello Juice had deliberately been expl...oiting employees by paying low, flat rates, resulting in underpayment of the ordinary hourly rates, and not including casual loadings and penalty rates for weekend and public holiday work they were entitled to under the Fast Food Industry Award 2010. The affected employees have now been back-paid. The company also breached workplace laws relating to pay slips and record-keeping and failed to comply with a Notice to Produce Records or documents from the FWO, resulting in a total of $276,929 in penalties. 20.01.2022 EXTENSION OF JOBKEEPER PROVISIONS Legislation has been passed to extend the provisions of the JobKeeper Enabling Directions of the Fair Work Act 2009 which will take effect from 28th September 2020 through to 28th March 2021. Eligible employers, under the extended provisions, may:... Stand down employees eg: a direction to work less or no hours Change an employees duties or work location Make agreements with their employees to change their days or times of work eg: an agreement that an employee will work on different days. However, employers will no longer be able to use the JobKeeper Enabling Directions to make agreements with their employees to take Annual Leave or to direct employees to take Annual Leave. This particular aspect of the provisions ceases on the 28th September 2020. From this date, employers and employees need to follow provisions for taking and requesting annual leave, including those set by a Modern Award or Enterprise Agreement. Employers not eligible to take action under the JobKeeper Enabling Directions should refer to a Modern Award where applicable as some of the abovementioned matters are also outlined within the Awards including the Clerks Private Sector Award 2020. 17.01.2022 CHANGES TO ACCRUAL OF PERSONAL/CARERS LEAVE In August 2019, the Federal Courts decision in the case of Modelez Australia Pty Ltd V AMWU prompted a significant change to personal/carers leave entitlements. This decision provided both full time and part time employees with a total of 10 days paid personal/carers leave regardless of the number of hours they work. The High Court of Australia on the 13th August, 2020 overturned the Federal Court decision and has reinstated ...the previous method of accruing and taking paid personal/carers leave as prescribed under the National Employment Standards and the Fair Work Act effective immediately and retrospective back to the date of the decision in August 2019, practically this means from a payroll perspective it is as though the decision never occurred. Full time and part time employees are entitled to paid personal/carers leave calculated based on an employees ordinary hours of work, not working days. 10 days of personal leave can be calculated as 1/26 of an employees ordinary hours of work in a year. In relation to any part time employees issued a Contract of Employment stating the higher entitlement, we recommend the Employer confirms the High Court decision in writing to the employee which outlines the decision and subsequent change that supersedes the previous contract issued. Employers should review their current payroll records and adjust the method of accruing personal/carers leave to reflect this decision where necessary. This increase equates to $13.00 per week and is the lowest it has been in many years and lower than the 3% increase in 2019.
