20.01.2022 Important information for NSW Members Motor Dealers and Repairers Amendment (Tradesperson's Certificates) Regulation 2020 The AGA is currently in consultation with the Australian Business License and Information Service and the NSW Department of Fair Trading to obtain further information in relation to the announced changes and to discuss the implementation of these changes and transitional arrangements for existing members of our industry. We are also in discussions with the relevant industry training providers to review the content and delivery of training packages that will enable our experienced members to meet the qualification requirements. Further updates will be provided as soon as new information is available.

In NSW if a business undertakes motor vehicle repair work, it requires a motor vehicle repairer’s licence. As from 1 November 2021, this will also include a business that undertakes auto glass repairs. If a business undertakes auto glass repairs only and does not already hold a motor vehicle repairers licence, the business must obtain a motor vehicle repairer’s licence by 1 November 2021. Visit the motor vehicle repairers page on the NSW Fair Trading website for further information about the obligations of motor vehicle repairers and how to apply for a licence Tradesperson Certificate In NSW a tradesperson who does motor vehicle repair work, requires a tradesperson’s certificate. As from 1 November 2021, this will also include auto glaziers, an auto glazier who wants to continue in this trade will need to obtain the minimum CERT ll qualification and hold a tradesperson certificate. This means Auto Glaziers in NSW should apply for a tradesperson’s certificate by the 1 August 2021 to allow time for their application to be processed. Visit the motor vehicle tradesperson’s page for further information about licensing requirements for tradesperson’s certificates including the qualification requirements for Auto Glass Repairs and the scope of work permitted under this repair class. Note: A tradesperson’s certificate does not authorise the holder to carry on a business of an auto glass repairer. 13.01.2022 UPDATE Motor Dealers and Repairers Amendment (Tradesperson's Certificates) Regulation 2020 To ALL our NSW Members... Following investigations, we can confirm the following, The proposed changes in regards to licensing and qualification requirements for the Auto Glazing Industry are currently subject of a Statutory Review of the Motor Dealers and Repairers Act 2013. This discussion paper was released on the 03/07/2020 by Kevin Anderson, MP Minister for Better Regulation, and Innovation, and we have until the 14/08/2020 to make submissions in relation to the questions raised. The AGA will be preparing a submission in response to the discussion paper and encourage relevant feedback from all our members and industry stakeholders. A written advice has also been sent to the Ministers office highlighting the following: As an industry we understand the need for change that will establish standards of conduct, licencing and a regulatory framework for auto glaziers to protect consumers and the industry, but due to the precedent of being a non-regulated industry, with no current access to the proposed training qualification (i.e. CERT II in Automotive Glazing Technology) there will need to be an implementation time frame allowing for a stepped approach of introducing the regulatory requirements. This will ensure that skills and experience of our industry participants are recognised at all entry levels. In addition, the AGA will be petitioning members for their input and are actively working with TAFE NSW for the delivery of a streamlined training package. The AGA would like to recognise the contribution and assistance received from Rowena Hayman of MJR Auto Glass who has assisted the AGA in sourcing and deciphering this critical information for our members and the industry.

08.01.2022 Announcement: On the 19 June, 2020 The NSW Minister for Better Regulation and Innovation KEVIN ANDERSON, MP. released an amendment to the Motor Dealers and Repairers Amendment (Miscellaneous) Regulation 2020 under the Motor Dealers and Repairers Act 2013. What this means is that in NSW, repairer's identified as per the Motor Dealers And Repairers Act 2013 must be licensed and employ certified tradespeople to do any repairs that affect the safety or performance of a vehicle.... The Motor Vehicle Repairer's Licence - New South Wales is obtained from the Australian Business Licence and Information Service (ABLIS) The announced amendments have made reference to and included Automotive Glazing as follow; Clause 34 Classes of repair work (c3) glazing work - being the work carried out by persons who install, repair or remove windscreens or other glass in or from the bodies of motor vehicles, but does not include work carried out on hybrid or electrically powered motor vehicles. The NSW Fair Trading website has now been updated to confirm the delayed commencement of the licensing and qualification requirements for Auto Glaziers. Information on changes to motor dealer, repairer and recycler laws: The Motor Dealers and Repairers Amendment (Tradespersons Certificates) Amendment Regulation 2020 makes the following amendments: Delays commencement of the glazing and electrical accessory fitting repair classes until 1 November 2021. This means tradespersons who don't hold a relevant tradespersons certificate for this work, but wish to undertake work in these new classes, will need to complete the prescribed qualification and obtain a tradespersons certificate by 1 November 2021. Removes the exclusion to work on hybrid or electrically powered motor vehicles from the exhaust and glazing repair classes.
