25.01.2022 Bannister Law announces class action against Hyundai over recall of Tuscon models. Hyundai is facing a class action following the safety recall of thousands of its popular Tuscon models. Bannister Law announced on Thursday it would investigate a potential claim against the popular car brand after it recalled 93,000 vehicles sold in Australia between November 2014 and November 2020. Hyundai last week recalled the medium-sized SUV model due to the risk of an engine compartment fire, even when the vehicle is turned off, as the circuit is constantly powered. The car company is contacting owners for a free repair. In the recall, Hyundai advised drivers affected vehicles need to be parked in an open space and away from flammable materials and structures, i.e. not in a garage. Bannister Law principal Charles Bannister said the firm was investigating a potential claim for losses for owners of the affected vehicles. We know from speaking to some of these drivers that this issue is keeping them up at night as it’s simply not possible for many city dwellers to park their car on the street, he said. We have heard from owners who are having to contend with bat excrement destroying paint work, damage from falling trees and branches and damage from cars and passers-by in busy, built up areas. The cars’ defect revolved around a manufacturing error, with an electronic control circuit board in the Anti-Lock Braking System (ABS) module short circuiting when the components were exposed to moisture.
