23.01.2022 WHY DO I NEED A WILL ANYWAY? A last Will and Testament is a legally binding document in which you stipulate how you want your estate to be dealt with in the event of your death. Making a Will allows you to provide for and protect your spouse, children and assets. You put the terms on how your estate is to be dealt with i.e. you have the final say! It is especially important if you have young children under the age of 18. Making a Will allows you the opportunity to appoint so...meone to be in charge of your estate and to carry out the directions you give in your Will. You can also appoint someone you trust to make decisions about the future of your children. If you die without a Will, the Queensland laws of intestacy which is outlined in Part 3 of the Succession Act, 1981, set out the rules of how your estate and assets will be distributed. Dying intestate will mean that your estate and assets may not be distributed to your beneficiaries in the way that you wish. There are specific rules as to how your estate will be divided if you do not have a Will. All in all, making a last Will and Testament gives you peace of mind knowing that you have taken the time now to think about your family’s future and how your death would affect them, both personally and financially. 19.01.2022 It’s Friday and today marks the final day of our Will Week. We would like to take this opportunity to thank all the staff who made this week possible! Today is also the final day of our Will Week inspired Frequently Asked Questions. Remember, if you have a question that you want answered, please do not hesitate to email us or contact us for an appointment. And on that note, our final Frequently Asked Question for this week is... What is Probate? Probate is a document i...ssued by the Supreme Court to give a Will the effect of a court order. Sometimes, when there are significant assets in an estate, it is necessary for Probate to be obtained by the Executor so that estate assets can be dealt with by them. Financial institutions and other entities holding the estate assets may require Probate to ensure that the Will is valid and that the Executor is the proper person to whom the assets should be released to on behalf of the estate. The process of obtaining Probate includes advertising in the local paper and Queensland Law Reporter, giving notice to the Public Trustee, filing an application and affidavits ( including the original Will and death certificate) in the Supreme Court Registry. The Registrar checks that everything is in order before issuing the Probate document. If there is something wrong with the Will or someone contests the Executor’s right to apply for probate then the Registrar may require additional information and / or refer the application to be determined by a Supreme Court Judge.

12.01.2022 CAN MY WILL BE CHALLENGED? The short answer is yes. Any Will can be challenged; however it is a different question as to whether or not the Will can be successfully challenged. There are a number of basis for challenging a Will. The main ones are challenges based on whether or not the person who made the Will understood what they were doing at the time the Will was made, whether or not they were unfairly influenced by someone when the Will was made, whether or not the ...Will was properly made and whether or not the Will made proper provision for those who were dependent on the Will maker. If you believe someone is likely to contest your Will, you cannot stop them from doing so, however you can make it difficult for them to be successful in any challenge by ensuring that your Will is properly made and that you are very clear about your wishes and the reasons why you have made your Will in that way. You may also consider taking steps during your life time to protect your assets from any potential claims. Your legal advisor can discuss your options with you.

07.01.2022 WHEN SHOULD I REVIEW MY EXISTING WILL? As circumstances change, it is a good idea to check your Will every year to ensure that it still fits your situation. If you have married since making your Will then you will need to make a new one unless your existing Will was made in contemplation of that marriage. If you divorce or separate from your partner then you should consider whether or not you need to change your Will. If the people you have nominated as executors or gu...ardians die or become incapacitated then you should consider whether you need to make alternate appointments. Similarly, if someone you have nominated as a beneficiary dies before you then you may need to consider an alternate beneficiary. If you have left a gift to someone eg. I give my house to Mr Smith, but you then sell your house, you should consider whether or not you need to change your Will as the existing Will would be read as though the gift of the house was never made to Mr Smith. Simply changing your address or occupation does not affect the terms of your Will however changes in your relationships, assets and the circumstances of your appointed executors and beneficiaries are reasons to update your Will to ensure it reflects your current wishes.

04.01.2022 I HAVE BEEN APPOINTED EXECUTOR, WHAT DO I DO? The Executor is the decision maker regarding the estate. Their role is firstly to secure any assets of the estate and ensure suitable living arrangements are made for the deceased’s dependents and pets. Next they must to ensure suitable funeral arrangements are made. Then the Executor’s duties are to gather the assets of the deceased, ensure any outstanding bills, debts or liabilities are paid and then distribute the balance of ...the estate in accordance with the deceased’s Will. Generally, the Executor must notify the various entities with whom the deceased had dealings including Centrelink, Medicare, Electricity Providers, Telephone company, Insurers, employers, banks, etc and satisfy their requirements for the deceased’s interests to be dealt with. Depending on the nature and extent of the estate, the Executor may need to take legal advice and or apply for Probate of the Will in order to administer the estate.
