24.01.2022 Welcome to the 2021 New Year. In Western Australia we have been blessed with the relative calm of life without COVID 19 and I would be the first to admit to liking the fact that we do not have to wear face masks and endure the restrictions and regulated day to day practices of other Australian cities. We are open for business and we welcome back both our new and existing clients to BD Legal Services in 2021. As Lawyers, it is easy to recite the law and to advise our clients w...ith informed advice on what to do. At BD Legal Services, we also assist our clients to work through the legal issues that they are facing, to provide our clients with the correct explanations so they can clearly interpret what the objectives are, and how best to achieve those results. This year we plan to expand our Legal Service to assist people who are victims of crime in regional areas as we know that legal services in regional areas can be problematic due to lawyers being conflicted to assist people because of past legal matters that they have been involved in. 17.01.2022 Christmas is a time of celebration but also a time of inevitable frustration due to parents and Grandparents being denied spending time with their children and Grandchildren. Time is running out to make a application to the Court for parenting orders. The 6 November 2020 is the last day for making applications to the Court, however the Court will still receive urgent recovery applications on a Ex Parte basis where allowed where children have been taken by parents in breach o...f existing Family Court orders, or where a child has been taken from a parent and the other parent is unreasonably withholding the child from the other parent. Parenting orders that require the Court to act urgently due to a risk of harm to the child’s mental and/or physical wellbeing may be heard on a urgent basis given the urgency of the matter. BD Legal Services is available for urgent recovery orders until the 20 December 2020. Call our offices to discuss your family matter in the strictest of confidence.

14.01.2022 With the extreme pressures that COVID 19 has placed on families, there is higher than usual incidents of violence in the community. Family violence is defined as behaviour which results in physical, sexual and/or psychological damage, forced social isolation, economic deprivation, or behaviour which causes the victim(s) to live in fear. This fear can contribute to the victims deteriorating mental health. Family violence can be experienced by people of all classes, religions..., ethnicity, ages, abilities and sexual preference. All victims are entitled to access services which are provided in a fair and equitable manner. If you need information and support to make yourself safe to end the abuse, there are actions that you can take. Is Domestic violence a crime? YES! Examples of criminal offences that occur in family violence situations include assault, sexual assault, making threats about a person's physical safety, stalking, damage or stealing of property and breaching Restraining Orders. If you are in a relationship where violence is affecting your life, you may apply for a family violence restraining order at the Magistrates Court. The application is heard with only you and the Magistrate in the Court. This hearing is called an Ex Parte hearing. 14.01.2022 On the 10 December 2019 we officially opened the offices of BD Legal Services in Malaga. Opening a business is difficult and never easy, opening a business during a pandemic provided a degree of challenges that we overcame to continue to provide our clients with the service and legal advice they required. We continue to develop our practice with professionalism, in the way we do things, our continuing efforts in updating our operating systems and fine tuning our management ap...proach to assist you in reaching the outcomes you want with the minimum of fuss. Finally I want to thank the people that have assisted me over the last 12 months with computer and IT problem solving, furniture removal and the help in setting up our offices at Suite 4, 691 Marshall Road in Malaga WA. I would also like to thank the 2 volunteers that provided me with their time during the year which I dearly miss, thank you Alex and Amanda for all your hard work. 13.01.2022 When a new client contacts us for advice and representation for their family law matter it is important that the right questions are directed to the client like: What are the immediate issues that the client needs assistance with? How we can assist our client and how would I want someone to explain the process to me?... Listening to the clients instructions and understanding their situation? Keeping those questions at the forefront of our practice philosophy allows me to help my clients in a way that is responsive to their needs and expectations. 10.01.2022 FamilyViolence The family Court is rolling out new measures to tackle an odious problem. "The Family Court is to unveil landmark reforms aimed at identifying families most at risk from #domesticviolence, #childabuse and drug and alcohol problems.... Parents battling over the care of their children will be asked to complete a confidential online questionnaire aimed at identifying whether their safety or welfare is at risk. The risk screening will not be mandatory, to ensure that litigants intent on gaming the system cannot delay a case by refusing to complete it. High-risk families will be placed in a new expedited court list known as the Evatt List, after the first Family Court chief justice Elizabeth Evatt. Ten specialist judges, selected for their training in family violence, will preside over the cases. Family Court of Australia Chief Justice Will Alstergren will announce the reforms, which will cost $13.5m over 2 years...on Thursday." This will not impact WA at this stage. Upon early examination the tendency for the need for this reform should assist people who are in need of protection, however more needs to be done in assisting victims in the Family Court.

08.01.2022 As part of the Indigenous Legal unit at Murdoch University that we supervise, it was a pleasure to introduce both semester 1 and semester 2 clinic students of 2020 to the internal workings of the Family Court of Western Australia. Principal Registrar Forrest provided the students who are mostly in their final years of their legal studies with a busy schedule of sitting in the courts and experiencing the court process first hand. We were privy to some very interesting matters... which provided plenty of discussion afterwards and followed by discussions with the Family Court consultant, Dept of Communities team leaders, Legal Aid duty lawyers and Principal Registrar Forrest who answered all our questions over a cuppa. Retired and former Chief Justice Thackray initiated our visit with the Court and it is with great sadness that we could not personally thank him for his ongoing support of young lawyers, community legal centres and the Indigenous legal clinic. Chief you are sadly missed. With exams fast approaching I wish you all the best for your upcoming exams.

06.01.2022 Being a parent is not easy work, there is no book of instructions or road map to assist parents in navigating the stresses of being the best parent we can be. The Department of Communities, Child Protection have the inevitable task to protect children from birth to the age of 18 years. The Department provides a range of child safety and family support services to Western Australian individuals, children, and their families, from the Kimberley to the Great Southern regions of... the State. Where a need arises, Care and Protection proceedings are brought before the Children’s Court if a child or children have been harmed, or there is a need for a child or children to be protected from harm. These matters involving applications for the removal of children in the Children’s Court are the most traumatic and heartbreaking legal proceedings most people can imagine. If you are involved in these proceedings, you need representation from compassionate and skillful lawyers, we can help you understand the process, what your options are and what you need to do to put yourself in the best possible position to have the children returned to your care. We are experienced in relation to the following matters: Time-limited Orders and Applications Until 18 Orders and Applications Special Guardianship Orders and Applications Trials and court dates in the Children’s Court Advice about Safety Plans, Signs of Safety Meetings, and section 143 Proposals If you have had contact with the Department, it is important to seek assistance immediately to seek advice, as in most cases there is no negotiation process to children being removed. Departmental workers and the Police have the right to remove children without consulting the parents if they have the opinion that a child is in need of protection.
