20.01.2022 Here is today’s Conveyancing tip: TIP 4. Ownership of Property... There are two different ways to own real estate in Queensland joint tenants and tenants in common. When you own a property as a joint tenant, you and the other owner own the property together. It is not divided into shares. You own the whole property together. If you own property as a joint tenant, you cannot bequeath that property in your Will. When a joint tenant dies, their ownership in the property passes to the surviving joint tenant. If you are the only surviving joint tenant, you will be the sole owner of the property. When you own property as a tenant in common, you own a defined share of the property. This might be an equal share with the other owners or a defined percentage (e.g. 50% each or 25% and 75%). If you die your share of the property is gifted via your Will. 18.01.2022 Today we continue our Conveyancing tips, here they are: TIP 2. Cooling off period... Once a residential Contract is fully executed and sent to all parties, there is a cooling off period for the Buyer of 5 business days (including the first day). However, if you terminate the Contract in the cooling off period, the Seller can charge a fee to you of .25% of the Purchase Price, which is deducted from the deposit paid. It’s important to get legal advice about options available to you before you take this step. TIP 3. Buying at auctions If you decide to buy a property at auction, generally the property will be offered for sale to the highest bidder. If your bid is accepted, you must sign an unconditional contract immediately. This means that, if you want to buy at auction, you need to make sure you are happy with all matters to do with the property before the auction. There is no cooling off period if you buy at auction. We recommend that searches on the property are conducted prior to auction and that plenty of time is given for those results to come back. 12.01.2022 To ensure that the administration for your estate is as easy as possible for your loved ones, we strongly recommend that a qualified solicitor draft your Will for you. Unfortunately, the courts are full of matters which are being litigated purely because a ‘home-made Will’ cannot be interpreted sensibly, has various interpretations or has not adequately considered all matters required. A well drafted Will also takes into account matters other than assets within the estate, such as superannuation and life insurance, to ensure that all of your assets are dealt with consistently. Importantly, a general discussion with us about the nature and extent of your assets and liabilities and our advice to you in that regard, can save your executors a great deal of time, money and stress.

10.01.2022 Here is our last Tip!! TIP 5. Transfer Duty and Land Tax... If you are buying an investment property or home to live in, you will need to know about: Transfer dutyall transfers of land and property are liable to transfer duty (formerly known as stamp duty). Transfer duty is charged on a sliding scale, based on the purchase price of the property. There is no separate transfer duty rate for seniors card or pensioner concession card holders. Additional duty of 7% of the purchase price of the property applies to acquisitions of residential property by foreign persons (including companies and trusts). See this link to calculate your potential transfer duty - https://www.qld.gov.au//calculating/estimate-transfer-duty Land taxthis tax is charged yearly on real estate owned by a person or other entity, such as a company or trust. It is calculated with reference to the total unimproved value of the property you own. It is therefore vital to obtain advice from your accountant and solicitor regarding the buying entity to purchase new real estate in. Land Tax is also charged based on a sliding scale of the value of unimproved property owned. Conditions It is a good idea to have conditions inserted into any Contract. Some that we recommend are: satisfactory building and pest inspection report; finance from your bank for the purchase; search results being satisfactory to you; all final approvals being issued for structures on the property; and settlement of the sale of your existing property. 01.01.2022 Home Owner Grants The Queensland First Home Owners’ Grant is a Queensland Government initiative to help first home owners get their new first home sooner. Depending on the date of your contract, you’ll get $15,000 or $20,000* towards buying or building your new house, unit or townhouse (valued at less than $750,000). You can even buy off the plan or choose to build yourself. To be eligible for the grant:... You must be an Australian citizen or permanent resident (or applying with someone who is). You or your spouse must not have previously owned property in Australia. You must be at least 18 years of age. You must be buying or building a brand new home, valued at less than $750,000. * The temporary increase of the Queensland First Home Owners’ Grant to $20,000 is available until 30 June 2018.
